REGULAR MEETING OF THE CITY COUNCIL
MARCH 28, 2006
A Regular Meeting of the City Council of the City of Ogallala, Nebraska, was held at City Hall Council Chambers in said City on the 28th day of March 2006 at 7:30 o’clock P.M. Present were: President of the Council: Paul Foy; Council Members: Larry Cumming, Tanya Gieschen, James Rezac and Mark Knudsen. Absent: None. City Manager: Steve Krajewski; City Clerk: Jane M. Skinner; City Attorney: Michael McQuillan.
Notice of the meeting was given in advance thereof by publishing one time in the Keith County News and posting at the City Hall Administration Building as shown by the Certificate of Publication and Posting Notice attached to these Minutes. Notice of this meeting was simultaneously given to the President and to all members of the Council on March 24, 2006 and a copy of their Acknowledgement of Receipt of Notice and the Agenda is attached to these minutes. Availability of the agenda was communicated in the advance notice and in the Notice to the President and Council of this meeting. All proceedings hereafter shown were taken while the convened meeting was open to the attendance of the public.
President Foy called the attention of the Council to the Consent Agenda for the meeting which was prepared and distributed to members of the Council on March 24, 2006. President Foy noted the Consent Agenda consisted of three items and asked if any member of the Council would prefer that any item on the Consent Agenda be removed and placed on the Regular Agenda for discussion. No Council Member asked for any item to be removed. Councilman Rezac moved to approve the Consent Agenda. The motion was seconded by Councilman Cumming. All present Council Members voted “Yes”. President Foy opened a public hearing regarding the Wellhead Protection Plan at 7:36 P.M.
President Foy proclaimed the month of April as Youth and Family Appreciation Month.
President Foy proclaimed the week of April 2-8, 2006 as National Library Week.
Drew Krab representing the Ogallala Optimists Club updated the council on the renovation of Humphrey’s Pond.
Councilwoman Gieschen moved to approve the claim to Ogallala Optimists for Tagge Engineering Consultants in the amount of $3,389.00. The motion was seconded by Councilman Knudsen. The following Council Members voted “Yes”: Paul Foy, Tanya Gieschen, Mark Knudsen and James Rezac. The following Council Members voted “No”: Larry Cumming. Absent: None. Motion declared carried.
Doug Leafgreen, Regional Care, Inc. appeared before the Council regarding a Health Savings Account for the City of Ogallala.
Councilman Rezac moved to direct the City Manager to prepare a proposal for the Council’s consideration, to include a Health Savings Account as a component of the City’s medical benefits package. The motion was seconded by Councilwoman Gieschen. The following Council Members voted “Yes”: Paul Foy, Larry Cumming, Tanya Gieschen, Mark Knudsen and James Rezac. The following Council Members voted “No”: None. Absent: None. Motion declared carried.
President Foy closed a public hearing regarding the Wellhead Protection Plan at 8:15 P.M.
Councilman Rezac introduced Ordinance No. 1231, entitled:
An Ordinance adding sectionS 52.050, 52.051, 52.052, 52.053, 52.054 and 52.055 to the ogallala municipal code to designate a wellhead protection plan and area.
Councilman Rezac moved that the Statutory Rule requiring the reading on three different days be suspended. Councilwoman Gieschen seconded the Motion. Upon roll call vote, the following Council Members voted “Yes”: Paul Foy, Larry Cumming, Tanya Gieschen, Mark Knudsen, and James Rezac. The following Council Members voted “No”: None. Absent: None. Motion declared carried and the Statutory Rule was declared suspended for the consideration of this Ordinance.
Ordinance No. 1231 was read by title and, thereafter, Councilman Cumming moved for the final passage of the Ordinance. The motion was seconded by Councilman Rezac. The President then stated the question: “Shall Ordinance No. 1231 be passed and adopted?” Upon roll call vote, the following Council Members voted “Yes”: Paul Foy, Larry Cumming, Tanya Gieschen, Mark Knudsen, and James Rezac. The following Council Members voted “No”: None. Absent: None. The passage and adoption of said Ordinance having been concurred in by a majority of all members of the Council, the President declared the Ordinance adopted and the President, in the presence of the Council, signed and approved the Ordinance and the Clerk attested to the passage and approval of the same and affixed her signature thereto, a copy of said Ordinance No.1231 being attached hereto and, by this express reference, incorporated herein and made a part hereof.
Councilwoman Gieschen moved to approve the Wellhead Protection Plan. The motion was seconded by Councilman Knudsen. The following Council Members voted “Yes”: Paul Foy, Larry Cumming, Tanya Gieschen, Mark Knudsen and James Rezac. The following Council Members voted “No”: None. Absent: None. Motion declared carried.
Councilwoman Gieschen moved to approve the contract with Central Tank Coatings, Inc. of Elgin, IA , in the amount of $20,300.00 for the renovation of the south water tower. The motion was seconded by Councilman Rezac. The following Council Members voted “Yes”: Paul Foy, Larry Cumming, Tanya Gieschen, Mark Knudsen and James Rezac. The following Council Members voted “No”: None. Absent: None. Motion declared carried.
Councilman Rezac moved to approve the Street Department maintenance building change order of $3,468.00 for a revised total contract amount of $405,589.00. The motion was seconded by Councilman Cumming. The following Council Members voted “Yes”: Paul Foy, Larry Cumming, Tanya Gieschen, Mark Knudsen and James Rezac. The following Council Members voted “No”: None. Absent: None. Motion declared carried.
Councilwoman Gieschen moved to award the contract on the Jacobsen Helgoth Consultant’s project No. 253-26 to Van Kirk Brothers Contracting, of Sutton, NE in an amount of $85,698.92. The motion was seconded by Councilman Knudsen. The following Council Members voted “Yes”: Paul Foy, Larry Cumming, Tanya Gieschen, Mark Knudsen and James Rezac. The following Council Members voted “No”: None. Absent: None. Motion declared carried.
Councilwoman Gieschen introduced a Resolution to apply for State and Federal Funding for the City of Ogallala Public Transportation System for Fiscal Year 2006-07. President Foy read the Resolution and Councilman Cumming moved that this Resolution be adopted. The motion was seconded by Councilman Rezac. Upon roll call vote, the following Council Members voted “Yes”: Paul Foy, Larry Cumming, Tanya Gieschen, Mark Knudsen, and James Rezac. The following Council Members voted “No”: None. Absent: None. Motion declared unanimously carried and Resolution No. 1195 adopted, a copy of said Resolution being attached hereto and, by this express reference, incorporated herein and made a part hereof.
Marion Kroeker, Director of the Community Redevelopment Area, appeared before the council regarding the Great West Townhomes, LLC redevelopment contract.
Councilman Rezac moved to support the Community Redevelopment Authority Great West Townhomes, LLC redevelopment contract. The motion was seconded by Councilwoman Gieschen. The following Council Members voted “Yes”: Paul Foy, Larry Cumming, Tanya Gieschen, Mark Knudsen and James Rezac. The following Council Members voted “No”: None. Absent: None. Motion declared carried.
There being no further business to come before the meeting, Councilman Rezac moved to adjourn. The motion was seconded by Councilwoman Gieschen. All present Council Member voted “Yes”: Absent: None. Motion declared carried and the meeting adjourned at 8:36 P.M.
