REGULAR MEETING OF THE CITY COUNCIL
JULY 24, 2007
A Regular Meeting of the City Council of the City of Ogallala, Nebraska, was held at City Hall Council Chambers in said City on the 24h day of July 2007 at 7:30 o’clock P.M. Present were: President of the Council: Darrell Bassett; Council Members: Kevin Block, Mark Knudsen, and Harold Peterson. Absent: James Rezac. City Manager: Steve Krajewski; City Clerk: Jane Skinner; City Attorney: Michael McQuillan.
Notice of the meeting was given in advance thereof by publishing one time in the Keith County News and posting at the City Hall Administration Building as shown by the Certificate of Publication and Posting Notice attached to these minutes. Notice of this meeting was simultaneously given to the President and to all members of the Council on July 20, 2007 and a copy of their Acknowledgement of Receipt of Notice and the Agenda is attached to these minutes. Availability of the agenda was communicated in the advance notice and in the Notice to the President and Council of this meeting. All proceedings hereafter shown were taken while the convened meeting was open to the attendance of the public. The President of the Council stated this meeting is being convened in accordance with the Open Meetings Act and acknowledged a copy of the Open Meetings Act being duly posted in the southeast Corner of Council Chambers.
Councilman Peterson moved to approve the consent agenda. Councilman Block seconded the motion. The following council members voted Yes: Darrell Bassett, Kevin Block, Mark Knudsen, and Harold Peterson. No: None. Absent: James Rezac. Councilman Rezac entered the meeting at 7:34 P.M.
Councilman Rezac moved to recommend approval of the Class C Liquor License Stagecoach Steakhouse/Convention Center-License C-38638 – Deletion to the license. Councilman Knudsen seconded the motion. The following council members voted Yes: Darrell Bassett, Kevin Block, Mark Knudsen, James Rezac and Harold Peterson. No: None. Absent: None. Motion declared carried.

Ken Knoepfel, Planning and Zoning Administrator, and Ron Schmidt appeared before the council regarding the Schmidt Motors Replat No. 1, a replat of Lots 1 through 10, Block 44, Aufdengarten’s 1st Addition to the City of Ogallala, Keith County, Nebraska. (500 block of East 1st, south side of street).
Councilman Rezac moved to table the Schmidt Motors Replat No. 1, a replat of Lots 1 through 10, Block 44, Aufdengarten’s 1st Addition to the City of Ogallala, Keith County, Nebraska. (500 block of East 1st, south side of street and direct City Manager Steve Krajewski and City Attorney Michael McQuillan to prepare a sales agreement with retention of easement for utilities. Councilman Knudsen seconded the motion. The following council members voted Yes: Kevin Block, Mark Knudsen, James Rezac and Harold Peterson. No: Darrell Bassett. Absent: None. Motion declared carried.
Councilman Rezac moved to approve Jehorek’s Replat, a Replat of Lot 2, Hillis’s Replat, an Administrative Replat of Lot 3, Ogallala Industrial Addition and a Part of Unplatted Lands Located in the SW ¼ of Section 2, Township 13 North, Range 39 West of the 6th P.M. all Located in Keith County Nebraska. Councilman Peterson seconded the motion. The following council members voted Yes: Darrell Bassett, Kevin Block, Mark Knudsen, James Rezac and Harold Peterson. No: None. Absent: None. Motion declared carried.
Councilman Rezac moved to approve a Corrective Replat of Mercer Replat, A Replat of Lot 5 and the West 40 feet of Lot 4, Block 7, Searle’s First Addition. Councilman Knudsen seconded the motion. The following council members voted Yes: Darrell Bassett, Kevin Block, Mark Knudsen, James Rezac and Harold Peterson. No: None. Absent: None. Motion declared carried.
Ray Diaz appeared before the council regarding the Ogallala Volunteer Fire Department Bylaws.
Councilman Block moved to approve the Ogallala Volunteer Fire Department by-laws. Councilman Rezac seconded the motion. The following council members voted Yes: Darrell Bassett, Kevin Block, Mark Knudsen, James Rezac and Harold Peterson. No: None. Absent: None. Motion declared carried.
Steve Krajewski, City Manager, informed the council that there was no new information to report on the Canyon Drive drainage issue at this time.
Councilman Rezac moved to negotiate a payment schedule for Paving District 2006-1 with the Ogallala Community Redevelopment Authority. Councilman Knudsen seconded the motion. The following council members voted Yes: Darrell Bassett, Kevin Block, Mark Knudsen, James Rezac and Harold Peterson. No: None. Absent: None. Motion declared carried.
City Manager Steve Krajewski informed the council that the revisions continue on the Municipal Code. The City Attorney is working with the library attorney on revisions to the code. A summary of the changes will be presented to the council.
Councilman Rezac moved to go into closed session to discuss water department land acquisition for well development at 8:12 P.M. Councilman Block seconded the motion. The following council members voted Yes: Darrell Bassett, Kevin Block, Mark Knudsen, James Rezac and Harold Peterson. No: None. Absent: None. Motion declared carried.
Council President Bassett stated the council was entering closed session to discuss water department land acquisition for well development at 8:12 P.M.
Councilman Knudsen moved to return from closed session where discussion occurred regarding water department land acquisition for well development at 8:22 P.M.
Councilman Rezac moved to approve the purchase agreement with Adams Bank and Trust to purchase property legally described as beginning at the Northeast corner of the Northwest Quarter (NW1/4) of Section 31; thence along the North line thereof, N 89º 19’ 30” W 67.87 feet to a point on the West line of the highway right-of-way; thence, along said West line, S 0º 24’ 30” W 72.22 feet to its intersection with the South line of a road right-of-way, the true point of beginning; thence, continuing on said West line S 0º 24’ 30” W 160.00 feet; thence, N 89º 19’ 30” W 140.00 feet; thence N 0º 24’ 30” E 160.00 feet; thence, along said South line, S 89º 19’ 30” E 140.00 feet to the true point of beginning for an amount of $25,000.00 to allow access to Williams Park, expansion to the park and well development. Councilman Peterson seconded the motion. The following council members voted Yes: Darrell Bassett, Kevin Block, Mark Knudsen, James Rezac and Harold Peterson. No: None. Absent: None. Motion declared carried.
There being no further business to come before the council, Councilman Peterson moved to adjourn. Councilman Rezac seconded the motion. Motion declared carried and the meeting adjourned at: 8:24 P.M.
