REGULAR MEETING OF THE CITY COUNCIL

 

SEPTEMBER 25, 2007

 

A Regular Meeting of the City Council of the City of Ogallala, Nebraska, was held at City Hall Council Chambers in said City on the 25th day of September 2007 at 7:30 o’clock P.M.  Present were:  President of the Council: Darrell Bassett; Council Members:  Kevin Block, Mark Knudsen Harold Peterson and Jim Rezac.  Absent:  None.  City Manager: Steve Krajewski; City Clerk: Jane Skinner; City Attorney:  Michael McQuillan.

 

Notice of the meeting was given in advance thereof by publishing one time in the Keith County News and posting at the City Hall Administration Building as shown by the Certificate of Publication and Posting Notice attached to these Minutes.  Notice of this meeting was simultaneously given to the President and to all members of the Council on September 21, 2007 and a copy of their Acknowledgement of Receipt of Notice and the Agenda is attached to these minutes.  Availability of the agenda was communicated in the advance notice and in the Notice to the President and Council of this meeting.  All proceedings hereafter shown were taken while the convened meeting was open to the attendance of the public.  The President of the Council stated this meeting is being convened in accordance with the Open Meetings Act and acknowledged a copy of the Open Meetings Act being duly posted in the southeast Corner of Council Chambers.  

 

Councilman Block moved to approve the consent agenda.  Councilman Knudsen seconded the motion.  The following council members voted Yes:  Darrell Bassett, Kevin Block, Mark Knudsen, and Harold Peterson.  No: None.  Absent: None. Abstain:  James Rezac Motion declared carried and the consent agenda was approved as follows:

Council President Bassett proclaimed October 5-7, 2007 to be Fallen Fire Fighter and Emergency Services Personnel Memorial Weekend in the City of Ogallala.

 

Councilman Rezac moved to incorporate the changes proposed to the City of Ogallala Municipal Code, being attached hereto and, by this express reference, incorporated herein and made a part hereof.  Councilman Peterson seconded the motion.  The following council members voted Yes:  Darrell Bassett, Kevin Block, Mark Knudsen, Harold Peterson and James Rezac.  No: None.  Absent: None.  Motion declared carried.

 

Councilman Block introduced Ordinance 1245.  President Bassett read Ordinance 1245 by title, “An ordinance enacting a Code of Ordinances for the City of Ogallala, Nebraska, revising, amending, restating, codifying and compiling certain existing general ordinances of the political subdivision dealing with subjects embraced in such code of ordinances, and declaring an emergency.”  President Bassett announced that Ordinance 1245 was read for the first time.

 

Councilman Rezac moved to approve the Agreement for sale and purchase of real estate legally described as: The east west alley located in Block 44, Aufdengarten’s 1st Addition to the City of Ogallala, Keith County, Nebraska to Ron Schmidt.  Councilman Knudsen seconded the motion.  The following council members voted Yes:  Kevin Block, Mark Knudsen, Harold Peterson and James Rezac.  No: Darrell Bassett.  Absent: None.  Motion declared carried.

 

Councilman Knudsen introduced Ordinance 1246, entitled:  An ordinance proposing the sale of a parcel of real estate legally described as: The east west alley located in Block 44, Aufdengarten’s 1st Addition to the City of Ogallala, Keith County, Nebraska, and moved that the Statutory Rule requiring the reading on three different days be suspended.  Councilman Rezac seconded the motion.  Upon roll call vote, the following Council Members voted “Yes”:  Kevin Block, Mark Knudsen, Harold Peterson, and James Rezac.  The following Council Members voted “No”: Darrell Bassett.  Absent: None.  Motion declared carried and the Statutory Rule was declared suspended for the consideration of this Ordinance.

 

Ordinance No. 1246 was read by title and, thereafter, Councilman Rezac moved for the final passage of the Ordinance.  Councilman Block seconded the motion.  The President then stated the question:  “Shall Ordinance No. 1246 be passed and adopted?”  Upon roll call vote, the following Council Members voted “Yes”:  Kevin Block, Mark Knudsen, Harold Peterson and James Rezac.  The following Council Members voted “No”: Darrell Bassett.  Absent: None.  The passage and adoption of said Ordinance having been concurred in by a majority of all members of the Council, the President declared the Ordinance adopted and the President, in the presence of the Council, signed and approved the Ordinance and the Clerk attested to the passage and approval of the same and affixed her signature thereto, a copy of said Ordinance No. 1246 being attached hereto and, by this express reference, incorporated herein and made a part hereof.

 

C.J. Poltack, representing West Central Development District appeared before the council regarding the Habitat for Humanity Community Development Assistance Act Tax Credit Application.

 

Councilman Rezac exited the meeting at 7:46 P.M.

 

Councilman Knudsen moved to authorize the Mayor to sign all documents necessary to certify Ogallala Chapter Habitat for Humanity proposed project is consistent with the City’s Comprehensive Plan.  Councilman Peterson seconded the motion.  The following council members voted Yes:  Darrell Bassett, Kevin Block, Mark Knudsen, and Harold Peterson.  No:  None.  Absent: James Rezac.  Motion declared carried.

 

Councilman Peterson moved to table the Humphrey’s Pond Restoration project until the October 9, 2007 meeting.  Councilman Block seconded the motion.  The following council members voted Yes:  Darrell Bassett, Kevin Block, Mark Knudsen, and Harold Peterson.  No:  None.  Absent: James Rezac.  Motion declared carried.

 

Steve Krajewski, City Manager, addressed the council regarding the Canyon Road Drainage.  The area was surveyed last Thursday, and utilities have been located.

 

Dave Kling, Police Chief appeared before the council regarding the Police Parking Lot Improvements. 

 

Councilman Rezac re-entered the meeting at 7:57 P.M.

 

Councilman Peterson moved to reject all bids on the police parking lot improvement project.  Councilman Rezac seconded the motion.  The following council members voted Yes:  Darrell Bassett, Kevin Block, Mark Knudsen, Harold Peterson and James Rezac.  No: None.  Absent: None.  Motion declared carried.

 

Councilman Knudsen moved to go into closed session to discuss City Manager employment agreement renewal at 8:08 P.M.  Councilman Rezac seconded the motion.  The following council members voted Yes:  Darrell Bassett, Kevin Block, Mark Knudsen, Harold Peterson and James Rezac.  No: None.  Absent: None.  Motion declared carried.

 

Council President Bassett announced the Council was going into closed session to discuss City Manager employment agreement renewal at 8:08 P.M.

Councilman Rezac moved to return from closed session where discussion occurred regarding City Manager employment agreement renewal at 8:47 P.M.  Councilman Peterson seconded the motion.  The following council members voted Yes:  Darrell Bassett, Kevin Block, Mark Knudsen, Harold Peterson and James Rezac.  No: None.  Absent: None.  Motion declared carried.

 

There being no further business to come before the council, Councilman Rezac moved to adjourn.  Councilman Knudsen seconded the motion.  All present Council Member voted “Yes”.  Motion declared carried and the meeting adjourned at 8:48 P.M.
