REGULAR MEETING OF THE CITY COUNCIL
APRIL 22, 2008
A Regular Meeting of the City Council of the City of Ogallala, Nebraska, was held at City Hall Council Chambers in said City on the 22nd day of April 2008 at 7:30 o’clock P.M. Present were: President of the Council: Darrell Bassett; Council Members: Kevin Block, Harold Peterson, and James Rezac. Absent: Mark Knudsen. Interim City Manager: Jane Skinner; Deputy City Clerk: Naomi Thiesen; City Attorney: Michael McQuillan.
Notice of the meeting was given in advance thereof by publishing one time in the Keith County News and posting at the City Hall Administration Building as shown by the Certificate of Publication and Posting Notice attached to these Minutes. Notice of this meeting was simultaneously given to the President and to all members of the Council on April 18, 2008 and a copy of their Acknowledgement of Receipt of Notice and the Agenda is attached to these minutes. Availability of the agenda was communicated in the advance notice and in the Notice to the President and Council of this meeting. All proceedings hereafter shown were taken while the convened meeting was open to the attendance of the public. The President of the Council stated this meeting is being convened in accordance with the Open Meetings Act and acknowledged a copy of the Open Meetings Act being duly posted in the southeast Corner of Council Chambers.
Councilman Rezac moved to excuse Councilman Knudsen from the April 22, 2008 Council Meeting. Council Peterson seconded the motion. The following council members voted Yes: Darrell Bassett, Kevin Block, Harold Peterson, and James Rezac. No: None. Absent: Mark Knudsen. Motion declared carried.

Council President Bassett opened a public hearing regarding the amendment to the Central South Redevelopment Area and the Blight Area Designation Study at 7:33 P.M.
Ken Knoepfel and Marty Schukert addressed the council regarding the amendment to the Central South Redevelopment Area and the Blight Area Designation Study.
Council President Bassett proclaimed May 1, 2008 as Loyalty Day in the City of Ogallala.
Council President Bassett proclaimed May 1, 2008 as the National Day of Prayer in the City of Ogallala.
Council President Bassett proclaimed April 27 – May 3, 2008 as National Volunteer Week in the City of Ogallala.
Council President Bassett closed the public hearing regarding the amendment to the Central South Redevelopment Area and the Blight Area Designation Study at 7:54 P.M.
Councilman Block moved to approve the amendment to the Central South Redevelopment Area and the Blight area designation study. Council Rezac seconded the motion. The following council members voted Yes: Darrell Bassett, Kevin Block, Harold Peterson, and James Rezac. No: None. Absent: Mark Knudsen. Motion declared carried.
Don Dye, representing M.C. Schaff, addressed the council regarding the 2008 Milling and Asphalt Overlay Project.
Councilman Rezac moved to accept the low bid from Werner Construction for the Milling and Asphalt Overlay Project for a total amount of $876,871.15. Councilman Peterson seconded the motion. The following council members voted Yes: Darrell Bassett, Kevin Block, Harold Peterson, and James Rezac. No: None. Absent: Mark Knudsen. Motion declared carried.
Don Dye, presenting M.C. Schaff, addressed the council regarding the Spruce Street Improvements & Ogallala Police Station Parking Lot.
Councilman Peterson moved to accept the low bid from Paulsen, Inc for the North Spruce Street Improvements & Ogallala Police Station Parking Lot for a total amount of $592,293.75. Council Block seconded the motion. The following council members voted Yes: Darrell Bassett, Kevin Block, Harold Peterson, and James Rezac. No: None. Absent: Mark Knudsen. Motion declared carried.
Carol Maxson, Ogallala Public Transit Director, addressed the council regarding the 2008-09 Funding Request.
Councilman Peterson introduced a resolution to apply for state and federal funding for the Ogallala Public Transportation system for Fiscal Year 2008-09 and moved for passage of said resolution. President Bassett read the Resolution and Councilman Rezac seconded the motion. Upon roll call vote, the following Council Members voted “Yes”: Darrell Bassett, Kevin Block, Harold Peterson, and Jim Rezac. The following Council Members voted “No”: None. Absent: Mark Knudsen. Motion declared carried and Resolution No. 1248 adopted, a copy of said Resolution being attached hereto and, by this express reference, incorporated herein and made a part hereof.
Lonnie Tickle, Cemetery Manager appeared before the council regarding mower bids.
Councilman Rezac moved to accept the low bid from Eichner’s Sales and Service for the Mower Purchase for a total amount of $17,075.00. Motion died for lack of a second.
Ken Knoepfel, Planning and Zoning Administrator, appeared before the council regarding a request for Special Exception to allow a professional office on property located at 406 West 3rd Street more particularly described as LOT 1 & EAST ½ of LOT 2, BLOCK 27, AUFDENGARTEN’S FIRST ADDITION.
Councilman Rezac moved to grant a special exception to allow a professional office on property located at 406 West 3rd Street more particularly described as LOT 1 & EAST ½ of LOT 2, BLOCK 27, AUFDENGARTEN’S FIRST ADDITION. Councilman Block seconded the motion. The following council members voted Yes: Darrell Bassett, Kevin Block, Harold Peterson, and James Rezac. No: None. Absent: Mark Knudsen. Motion declared carried.
Ken Priesner, presenting Plumbing Plus, appeared before the council regarding the outdoor pool boiler.
Councilman Rezac moved to accept the low bid from Erthum’s Sheet Metal Heating & Cooling for the Outdoor Pool Boiler Project for a total amount of $21,650.00. Councilman Peterson seconded the motion. The following council members voted Yes: Darrell Bassett, Kevin Block, Harold Peterson, and James Rezac. No: None. Absent: Mark Knudsen. Motion declared carried
C.J. Poltack representing West Central Development District, appeared before the council regarding Habitat for Humanity Community Development Assistance Act Tax Credit.
Councilman Block introduced a resolution requesting West Central Nebraska Development District to pursue Community Development Assistance Act Tax Credit funding for a habitat for humanity project and moved for passage of said resolution. President Bassett read the Resolution and Councilman Rezac seconded the motion. Upon roll call vote, the following Council Members voted “Yes”: Darrell Bassett, Kevin Block, Harold Peterson, and Jim Rezac. The following Council Members voted “No”: None. Absent: Mark Knudsen. Motion declared carried and Resolution No. 1249 adopted, a copy of said Resolution being attached hereto and, by this express reference, incorporated herein and made a part hereof.
The council discussed the City Council Salary and decided they would discuss this at a future meeting.
Councilman Block moved to approve the claim for reimbursement of expenses for Steven Bloomberg in the amount of $405.19. Councilman Peterson seconded the motion. The following council members voted Yes: Darrell Bassett, Kevin Block, and Harold Peterson. No: James Rezac. Absent: Mark Knudsen. Motion declared carried
There being no further business to come before the council, Councilman Rezac moved to adjourn. Councilman Block seconded the motion. All present Council Member voted “Yes”. Motion declared carried and the meeting adjourned at 8:42 P.M.
