REGULAR MEETING OF THE CITY COUNCIL
MAY 27, 2008
A Regular Meeting of the City Council of the City of Ogallala, Nebraska, was held at City Hall Council Chambers in said City on the 27th day of May 2008 at 7:30 o’clock P.M. Present were: President of the Council: Darrell Bassett; Council Members: Kevin Block, Mark Knudsen and Harold Peterson. Absent: James Rezac. City Manager: Harold Stewart; City Clerk: Jane Skinner; City Attorney: Michael McQuillan.
Notice of the meeting was given in advance thereof by publishing one time in the Keith County News and posting at the City Hall Administration Building as shown by the Certificate of Publication and Posting Notice attached to these Minutes. Notice of this meeting was simultaneously given to the President and to all members of the Council on May 23, 2008 and a copy of their Acknowledgement of Receipt of Notice and the Agenda is attached to these minutes. Availability of the agenda was communicated in the advance notice and in the Notice to the President and Council of this meeting. All proceedings hereafter shown were taken while the convened meeting was open to the attendance of the public. The President of the Council stated this meeting is being convened in accordance with the Open Meetings Act and acknowledged a copy of the Open Meetings Act being duly posted in the southeast Corner of Council Chambers.
Mayor Bassett proclaimed May 31st to June 7th 2008 as Habitat for Humanity Awareness Week in Ogallala.
Councilman Block moved to approve the minutes of the regular meeting held May 13, 2008. Councilman Knudsen seconded the motion. The following council members voted Yes: Darrell Bassett, Kevin Block, and Mark Knudsen. No: None. Abstain: Harold Peterson. Absent: James Rezac. Motion declared carried.

Councilman Peterson introduced Ordinance 1251, entitled: An ordinance rezoning
the following described real estate South ½ of Blocks 15 and 16, Original
Town in Ogallala from R-2 (Residential District-Medium Density) to C-2 (Business
District-Highway) and moved that the Statutory Rule requiring the reading on
three different days be suspended. Councilman Block seconded the motion. Upon
roll call vote, the following Council Members voted “Yes”: Darrell Bassett,
Kevin Block, Mark Knudsen, and Harold Peterson. The following Council Members
voted “No”: None. Absent: James Rezac. Motion declared carried and the
Statutory Rule was declared suspended for the consideration of this Ordinance.
Ordinance No. 1251 was read by title and, thereafter, Councilman Knudsen moved for the final passage of the Ordinance. Councilman Peterson seconded the motion. The President then stated the question: “Shall Ordinance No. 1251 be passed and adopted?” Upon roll call vote, the following Council Members voted “Yes”: Darrell Bassett, Kevin Block, Mark Knudsen, and Harold Peterson. The following Council Members voted “No”: None. Absent: James Rezac. The passage and adoption of said Ordinance having been concurred in by a majority of all members of the Council, the President declared the Ordinance adopted and the President, in the presence of the Council, signed and approved the Ordinance and the Clerk attested to the passage and approval of the same and affixed her signature thereto, a copy of said Ordinance No. 1251 being attached hereto and, by this express reference, incorporated herein and made a part hereof.
Marion Kroeker addressed the council regarding the Community Redevelopment Authority US Recycling TIF Project. This community development project is located at 5 East E Street.
Councilman Knudsen moved to approve the CRA Resolution 08-02 approving US Recycling TIF Project application and incorporating the Project in the Redevelopment Plan. Councilman Block seconded the motion. The following council members voted Yes: Darrell Bassett, Kevin Block, Mark Knudsen, and Harold Peterson. No: None. Absent: James Rezac. Motion declared carried
Councilman Knudsen moved to approve 2008 Milling and Asphalt Overlay Project Change Order number 1, increasing the contract amount from $876,871.15 to $878,685.55, a difference of $1,814.40. Councilman Peterson seconded the motion. The following council members voted Yes: Darrell Bassett, Kevin Block, Mark Knudsen, and Harold Peterson. No: None. Absent: James Rezac. Motion declared carried
Fire Chief Bill Fortune presented the Ogallala Volunteer Fire Department 2007 Annual Report.
City Manager Harold Stewart recognized four members of the Ogallala Volunteer Fire Department: Jeff Paul, Wes Schmer, David Seitler, and Jeremy Rechsteiner for their service to an accident victim while traveling home from fire school.
There being no further business to come before the council, Councilman Peterson moved to adjourn. Councilman Knudsen seconded the motion. All present Council Member voted “Yes”. Motion declared carried and the meeting adjourned at 7:56 P.M.
