REGULAR MEETING OF THE CITY COUNCIL
OCTOBER 28, 2008
A Regular Meeting of the City Council of the City of Ogallala, Nebraska, was held at City Hall Council Chambers in said City on the 23th day of September 2008 at 7:30 o’clock P.M. Present were: President of the Council: Darrell Bassett; Council Members: Kevin Block, Mark Knudsen, Harold Peterson and James Rezac. Absent: None. City Manager: Harold Stewart; City Clerk: Jane Skinner; City Attorney: Michael McQuillan.
Notice of the meeting was given in advance thereof by publishing one time in the Keith County News and posting at the City Hall Administration Building as shown by the Certificate of Publication and Posting Notice attached to these Minutes. Notice of this meeting was simultaneously given to the President and to all members of the Council on October 24, 2008 and a copy of their Acknowledgement of Receipt of Notice and the Agenda is attached to these minutes. Availability of the agenda was communicated in the advance notice and in the Notice to the President and Council of this meeting. All proceedings hereafter shown were taken while the convened meeting was open to the attendance of the public. The President of the Council stated this meeting is being convened in accordance with the Open Meetings Act and acknowledged a copy of the Open Meetings Act being duly posted in the southeast Corner of Council Chambers.
Councilman Rezac moved to approve the minutes of the Regular Meeting held October 14, 2008. Councilman Knudsen seconded the motion. The following council members voted Yes: Darrell Bassett, Mark Knudsen, and James Rezac. No: None. Abstain: Kevin Block and Harold Peterson Absent: None. Motion declared carried.
Councilman Block moved for the approval of a license to perform work within the Public Right of Way to Charles Morland. Councilman Knudsen seconded the motion. The following council members voted Yes: Darrell Bassett, Kevin Block, Mark Knudsen, Harold Peterson and James Rezac. No: None. Absent: None. Motion declared carried.
Councilman Peterson moved to approve the Fire Department roof repair specifications, bid advertising and opening dates. Councilman Block seconded the motion. The following council members voted Yes: Darrell Bassett, Kevin Block, Mark Knudsen, Harold Peterson and James Rezac. No: None. Absent: None. Motion declared carried.
Councilman Knudsen moved to accept the 2008 Asphalt Mill and Overlay project as a completed job. Councilman Block seconded the motion. The following council members voted Yes: Darrell Bassett, Kevin Block, Mark Knudsen, Harold Peterson and James Rezac. No: None. Absent: None. Motion declared carried.
Councilman Knudsen moved to approve the 2008 Asphalt Mill and Overlay – Final Pay Request for Werner Construction in the amount of $31,923.06. Councilman Rezac seconded the motion. The following council members voted Yes: Darrell Bassett, Kevin Block, Mark Knudsen, Harold Peterson and James Rezac. No: None. Absent: None. Motion declared carried.
Councilman Knudsen moved to approve the 2008 Asphalt Mill and Overlay – Final Pay Request for M.C. Schaff & Associates in the amount of $3,979.00. Councilman Peterson seconded the motion. The following council members voted Yes: Darrell Bassett, Kevin Block, Mark Knudsen, Harold Peterson and James Rezac. No: None. Absent: None. Motion declared carried.
John Trecek from Ameritas Investment addressed the council regarding the $965,000 Various Purpose Bonds, Series 2008 of the City of Ogallala.
Councilman Block introduced Ordinance 1254, entitled: an ordinance authorizing the issuance of various purpose bonds, series 2008, of the city of Ogallala, Nebraska, in the principal amount of nine hundred sixty-five thousand dollars ($965,000) issued for the purpose of paying the cost of paving intersections and areas formed by the crossing of streets and alleys within the city in paving districts nos. 2007-1 and 2007-2 and paying the cost of paving streets and alleys within said districts exclusive of said intersections; prescribing the form of said bonds; providing for a sinking fund and for the levy and collection of taxes to pay said bonds; providing for the sale of the bonds; authorizing the delivery of the bonds to the purchaser; providing for the disposition of the bond proceeds and ordering the ordinance published in pamphlet form and moved that the Statutory Rule requiring the reading on three different days be suspended. Councilman Peterson seconded the motion. Upon roll call vote, the following Council Members voted “Yes”: Darrell Bassett, Kevin Block, Mark Knudsen, Harold Peterson and James Rezac. The following Council Members voted “No”: None. Absent:. Motion declared carried and the Statutory Rule was declared suspended for the consideration of this Ordinance.
Ordinance No. 1254 was read by title and, thereafter, Councilman Block moved for the final passage of the Ordinance. Councilman Knudsen seconded the motion. The President then stated the question: “Shall Ordinance No. 1254 be passed and adopted?” Upon roll call vote, the following Council Members voted “Yes”: Darrell Bassett, Kevin Block, Mark Knudsen, Harold Peterson and James Rezac. The following Council Members voted “No”: None. Absent: None. The passage and adoption of said Ordinance having been concurred in by a majority of all members of the Council, the President declared the Ordinance adopted and the President, in the presence of the Council, signed and approved the Ordinance and the Clerk attested to the passage and approval of the same and affixed her signature thereto, a copy of said Ordinance No. 1254 being attached hereto and, by this express reference, incorporated herein and made a part hereof.
Councilman Rezac introduced a resolution authorizing a contract for a loan. President Bassett read the resolution and Councilman Block seconded the motion. Upon roll call vote, the following Council Members voted “Yes”: Darrell Bassett, Kevin Block, Mark Knudsen, Harold Peterson, and James Rezac. The following council Members voted “No”: None. Absent: None. Motion declared carried and Resolution No. 1260 adopted, a copy of said Resolution being attached hereto and by this express reference, incorporated herein and made a part hereof.
Councilman Block moved to approve the claims. Councilman Rezac seconded the motion. The following council members voted Yes: Darrell Bassett, Kevin Block, Mark Knudsen, Harold Peterson and James Rezac. No: None. Absent: None. Motion declared carried.

Councilman Block commented how nice the ADA compliant bathroom that has recently been renovated at the fire hall looks.
Mark Rezac moved to commence closed session at 7:59 P.M. to discuss the six-month evaluation of the City Manager. Councilman Block seconded the motion. The following council members voted yes: Darrell Bassett, Kevin Block, Mark Knudsen, Harold Peterson and James Rezac. No: None. Absent: None. Motion declared carried.
Council President Bassett announced the council would be entering closed session to discuss the six-month evaluation of the City Manager at 7:59 P.M.
Councilman Peterson moved to return from closed session at 8:27 P.M. where the six month evaluation of the City Manager. was discussed. Councilman Rezac seconded the motion. The following council members voted yes: Darrell Bassett, Kevin Block, Mark Knudsen, Harold Peterson and James Rezac. No: None. Absent: None. Motion declared carried.
There being no further business to come before the council, Councilman Peterson moved to adjourn at 8:28 P.M. Councilman Knudsen seconded the motion. The following council members voted Yes: Darrell Bassett, Kevin Block, Mark Knudsen, Harold Peterson and James Rezac. No: None. Absent: None. Motion declared carried.
