REGULAR MEETING OF THE CITY COUNCIL
NOVEMBER 25, 2008
A Regular Meeting of the City Council of the City of Ogallala, Nebraska, was held at City Hall Council Chambers in said City on the 25th day of November 2008 at 7:30 o’clock P.M. Present were: President of the Council: Darrell Bassett; Council Members: Kevin Block, and Harold Peterson. Absent: Mark Knudsen and James Rezac. City Manager: Harold Stewart; City Clerk: Jane Skinner; City Attorney: Michael McQuillan.
Notice of the meeting was given in advance thereof by publishing one time in the Keith County News and posting at the City Hall Administration Building as shown by the Certificate of Publication and Posting Notice attached to these Minutes. Notice of this meeting was simultaneously given to the President and to all members of the Council on November 21, 2008 and a copy of their Acknowledgement of Receipt of Notice and the Agenda is attached to these minutes. Availability of the agenda was communicated in the advance notice and in the Notice to the President and Council of this meeting. All proceedings hereafter shown were taken while the convened meeting was open to the attendance of the public. The President of the Council stated this meeting is being convened in accordance with the Open Meetings Act and acknowledged a copy of the Open Meetings Act being duly posted in the southeast Corner of Council Chambers.
Councilman Block moved to approve the consent agenda. Councilman Peterson seconded the motion. The following council members voted Yes: Darrell Bassett, Kevin Block, and Harold Peterson. No: None. Councilman Rezac entered the meeting at 7:32 P.M.
Council President Bassett opened a public hearing regarding a request for special exception to locate a dog breeding and selling facility on property located at 199 Peterson Drive more particularly described as Springer’s Replat of Lot 5, VanVelson’s First Addition in Ogallala. (Keith & Kris Springer) at 7:32 P.M.
Ken Knoepfel, Planning and Zoning Administrator, Kris Springer, Iris Olofson, Mike Samuelson, Keith Springer and Dr. David Baltzell addressed the council regarding a request for special exception to locate a dog breeding and selling facility on property located at 199 Peterson Drive more particularly described as Springer’s Replat of Lot 5, VanVelson’s First Addition in Ogallala.
Councilman Knudsen entered the meeting at 7:38 P.M.
Councilman Peterson moved to approve the minutes of the regular meeting held November 11, 2008. Councilman Block seconded the motion. The following council members voted Yes: Darrell Bassett, Kevin Block, Mark Knudsen, and Harold Peterson. No: None. Abstain: James Rezac. Absent: None. Motion declared carried.
Council President Bassett stated that Ordinance 1255 was introduced and read for the first time on November 11, 2008. Ordinance 1255 is an ordinance amending 41-502 Maximum Speed of the Municipal Code of the City of Ogallala, Nebraska. Council President Bassett stated that Ordinance 1255 has now been read for the second time.
Dave Barrett, representing Wild West Soap Box Derby addressed the council regarding a funding request.
Councilman Rezac moved to approve the request of the Wild West Soap Box Derby for an additional $1,343 above the $5,000 approved in the FY 2008-2009 budget, to reimburse for expenses incurred during the installation of a sprinkler system. Councilman Peterson seconded the motion. The following council members voted yes: Darrell Bassett, Kevin Block, Mark Knudsen, Harold Peterson, and James Rezac. No: None. Absent: None. Motion declared carried.
Councilman Block moved to approve the interlocal agreement with Keith County for promotion and implementation of economic development. Councilman Knudsen seconded the motion. The following council members voted yes: Darrell Bassett, Kevin Block, Mark Knudsen, Harold Peterson, and James Rezac. No: None. Absent: None. Motion declared carried.
Council President Bassett closed a public hearing regarding a request for special exception to locate a dog breeding and selling facility on property located at 199 Peterson Drive more particularly described as Springer’s Replat of Lot 5, VanVelson’s First Addition in Ogallala. (Keith & Kris Springer) at 7:59 P.M.
Councilman Knudsen moved to grant a special exception to locate a dog breeding and selling facility on property located at 199 Peterson Drive more particularly described as Springer’s Replat of Lot 5, VanVelson’s First Addition in Ogallala to Keith and Kris Springer with the condition that they construct a sound and visual barrier prior to May 15, 2009. Councilman Block seconded the motion. The following council members voted yes: Darrell Bassett, Kevin Block, Mark Knudsen, Harold Peterson, and James Rezac. No: None. Absent: None. Motion declared carried.
Councilman Rezac moved to approve Water-Variable Frequency Drive change order no. 1 amending the total contract amount from $66,750 to $68,700, a difference of $1,950. Councilman Peterson seconded the motion. The following council members voted yes: Darrell Bassett, Kevin Block, Mark Knudsen, Harold Peterson, and James Rezac. No: None. Absent: None. Motion declared carried.
Councilman Peterson introduced a resolution authorizing the position economic development coordinator and funding one position for FY 2008-2009. President Bassett read the resolution and Councilman Block seconded the motion. Upon roll call vote, the following Council Members voted “Yes”: Darrell Bassett, Kevin Block, Mark Knudsen, and Harold Peterson. The following council Members voted “No”: James Rezac. Absent: None. Motion declared carried and Resolution No. 1262 adopted, a copy of said Resolution being attached hereto and by this express reference, incorporated herein and made a part hereof.
Councilman Knudsen moved to amend the City Manager’s contract as recommended and presented by staff with an effective date of the automobile stipend being 10-1-08. Councilman Rezac seconded the motion. The following council members voted yes: Darrell Bassett, Kevin Block, Mark Knudsen, Harold Peterson, and James Rezac. No: None. Absent: None. Motion declared carried.
There being no further business to come before the council, Councilman Rezac moved to adjourn at 8:36 P.M. Councilman Peterson seconded the motion. The following council members voted Yes: Darrell Bassett, Kevin Block, Mark Knudsen, Harold Peterson and James Rezac. No: None. Absent: None. Motion declared carried.
