REGULAR MEETING OF THE CITY COUNCIL

APRIL 28, 2009

A Regular Meeting of the City Council of the City of Ogallala, Nebraska, was held at City Hall Council Chambers in said City on the 28^thday of April 2009 at 7:30 o’clock P.M. Present were: President of the Council: Darrell Bassett; Council Members: Stacey Bauer, Kevin Block, Mark Knudsen and Harold Peterson. Absent: None; City Manager: Harold Stewart; City Clerk: Jane Skinner; City Attorney: Absent.

Notice of the meeting was given in advance thereof by publishing one time in the Keith County News and posting at the City Hall Administration Building as shown by the Certificate of Publication and Posting Notice attached to these Minutes. Notice of this meeting was simultaneously given to the President and to all members of the Council on April 24, 2009 and a copy of their Acknowledgement of Receipt of Notice and the Agenda is attached to these minutes. Availability of the agenda was communicated in the advance notice and in the Notice to the President and Council of this meeting. All proceedings hereafter shown were taken while the convened meeting was open to the attendance of the public. The President of the Council stated this meeting is being convened in accordance with the Open Meetings Act and acknowledged a copy of the Open Meetings Act being duly posted in the southeast Corner of Council Chambers.

Councilman Peterson moved to approve the consent agenda. Councilman Block seconded the motion. The following council members voted Yes: Darrell Bassett, Stacey Bauer, Kevin Block, Mark Knudsen, and Harold Peterson. No: None. Absent: None. Motion declared carried and the consent agenda was approved as follows:

Mayor Bassett proclaimed Thursday, the seventh day of May, 2009, as a National Day of Prayer in Ogallala, Nebraska.

Mayor Bassett proclaimed Census 2010 as a top priority for all departments and appointed officials, and encouraged the community to place an emphasis within our jurisdiction of partnering together with the U.S. Census Bureau in achieving an accurate and complete count in Census 2010.

Councilman Knudsen moved to amend the Engineering Agreement for Six place T-Hangar (3-31-0060-06(B01)) increasing the amount to be paid to Olsson and Associates from $70,142 to $85,635, a difference of $15,493. Councilman Bauer seconded the motion. The following council members voted Yes: Darrell Bassett, Stacey Bauer, Kevin Block, Mark Knudsen, and Harold Peterson. No: None. Absent: None. Motion declared carried.

Councilman Bauer moved to amend the plans, specifications, bid advertising and opening dates for the Searle Field Six Place T-Hangar Project (3-31-0060-06(B01)) as recommended. Councilman Peterson seconded the motion. The following council members voted Yes: Darrell Bassett, Stacey Bauer, Kevin Block, Mark Knudsen, and Harold Peterson. No: None. Absent: None. Motion declared carried.

Councilman Block introduced a resolution approving an amendment to the City of Ogallala Owner-Occupied Rehab Guidelines of CDBG Contract 08-HO-3073. Council President Bassett read the resolution and Councilman Bauer seconded the motion. Upon roll call vote, the following Council Members voted “Yes”: Darrell Bassett, Stacey Bauer, Kevin Block, Mark Knudsen, and Harold Peterson. The following council Members voted “No”: None. Absent: None. Motion declared carried and Resolution No. 1271 adopted, a copy of said Resolution being attached hereto and by this express reference, incorporated herein and made a part hereof.

Fire Chief Fortune presented the Ogallala Volunteer Fire Department Annual Report for 2008.

City Manager Stewart addressed the Council regarding the Water Service Agreement with Trails Crossing.

Tom Werblow and Brent Burklund addressed the council regarding the City Water Engineer.

Councilman Knudsen moved to enter into an agreement with TC Engineering of North Platte, Nebraska to be the City’s Water System and Wastewater Collection System engineer. Councilman Block seconded the motion. The following council members voted Yes: Darrell Bassett, Stacey Bauer, Kevin Block, Mark Knudsen, and Harold Peterson. No: None. Absent: None. Motion declared carried.

There being no further business to come before the council, Councilman Knudsen moved to adjourn at 8:08 P.M. Councilman Block seconded the motion. The following council members voted Yes: Darrell Bassett, Stacey Bauer, Kevin Block, Mark Knudsen, and Harold Peterson. No: None. Absent: None. Motion declared carried.
