REGULAR MEETING OF THE CITY COUNCIL

 

MAY 26, 2009

 

A Regular Meeting of the City Council of the City of Ogallala, Nebraska, was held at City Hall Council Chambers in said City on the 26th day of May 2009 at 7:30 o’clock P.M.  Present were:  President of the Council: Darrell Bassett; Council Members:  Stacey Bauer, Kevin Block, and Harold Peterson.  Absent:  Mark Knudsen; City Manager:  Harold Stewart; City Clerk:  Jane Skinner; City Attorney:  Michael McQuillan.

 

Notice of the meeting was given in advance thereof by publishing one time in the Keith County News and posting at the City Hall Administration Building as shown by the Certificate of Publication and Posting Notice attached to these Minutes.  Notice of this meeting was simultaneously given to the President and to all members of the Council on May 22, 2009 and a copy of their Acknowledgement of Receipt of Notice and the Agenda is attached to these minutes.  Availability of the agenda was communicated in the advance notice and in the Notice to the President and Council of this meeting.  All proceedings hereafter shown were taken while the convened meeting was open to the attendance of the public.  The President of the Council stated this meeting is being convened in accordance with the Open Meetings Act and acknowledged a copy of the Open Meetings Act being duly posted in the southeast Corner of Council Chambers.

 

Councilman Block moved to approve the consent agenda.  Councilman Peterson seconded the motion.  The following council members voted Yes:  Darrell Bassett, Stacey Bauer, Kevin Block, and Harold Peterson.  No: None.  Absent: Mark Knudsen.  Motion declared carried and the consent agenda was approved as follows:

Mary Dickinson, Chairman of the Ogallala Youth Committee, presented the Ogallala Youth Committee Mission Statement, Vision and Goals.

 

Councilman Knudsen entered the meeting at 7:33 P.M.

 

Wendell Upright presented to the Council a Memorial Tree Plaque to be displayed at the City Administration Building.

 

Councilman Knudsen moved to enter into a contract with Paul Reed Construction & Supply, Inc. of Gering, Nebraska for the construction of Storage Hangar, Hangar Taxiway & Offices and Heat System for Hangar in the amount of $419,987.56.  Councilman Block seconded the motion.  The following council members voted Yes:  Darrell Bassett, Stacey Bauer, Kevin Block, Mark Knudsen, and Harold Peterson.  No: None.  Absent: None.  Motion declared carried.

 

Councilman Peterson moved to accept the quitclaim deed from Allyn Sutton for 50 square feet located on East E Street, south of Highway 30.  Councilman Bauer seconded the motion.  The following council members voted Yes:  Darrell Bassett, Stacey Bauer, Kevin Block, Mark Knudsen, and Harold Peterson.  No: None.  Absent: None.  Motion declared carried.

 

Maggie O’Neil, Personal Trainer, appeared before the council regarding Personal Trainer Fees.

 

Councilman Knudsen moved that City Manager Stewart comes up with a fee structure for personal training that he and Maggie deem fit.  Councilman Bauer seconded the motion.  The following council members voted Yes:  Darrell Bassett, Stacey Bauer, Kevin Block, Mark Knudsen, and Harold Peterson.  No: None.  Absent: None.  Motion declared carried.

 

Councilman Knudsen moved to appoint Buck Bassett to serve as the Council ex-officio on the Keith County Area Development Board.  Councilman Bauer seconded the motion.  The following council members voted Yes: Stacey Bauer, Kevin Block, Mark Knudsen, and Harold Peterson.  No: None.  Absent: None.  Abstain:  Darrell Bassett.  Motion declared carried.

 

Don Blankenau, representing Ogallala Land Holdings, LLC, addressed the council regarding the Water Service Agreement with Trails Crossing/Ogallala Land Holdings, LLC.

 

Councilman Bauer moved to terminate the Water Service Agreement with Ogallala Land Holdings, LLC due to default of the March 31, 2008 payment and failure to comply after 30 days written notice and to notify the land owner.  Councilman Peterson seconded the motion.  The following council members voted Yes:  Darrell Bassett, Stacey Bauer, Kevin Block, Mark Knudsen, and Harold Peterson.  No: None.  Absent: None.  Motion declared carried.

 

Councilman Knudsen moved to appoint Thomas Cubbage to the Ogallala Youth Committee Board for a term to expire on December 31, 2011.  Councilman Bauer seconded the motion.  The following council members voted Yes:  Darrell Bassett, Stacey Bauer, Kevin Block, Mark Knudsen, and Harold Peterson.  No: None.  Absent: None.  Motion declared carried.

 

Councilman Knudsen moved to enter closed session at 8:24 P.M. to discuss the City Manager Evaluation. Councilman Block seconded the motion.  The following council members voted Yes:  Darrell Bassett, Stacey Bauer, Kevin Block, Mark Knudsen, and Harold Peterson.  No:  None.  Absent: None.  Motion declared carried.

 

Council President Bassett announced the City Council was entering closed session at 8:24 P.M. to discuss the City Manager Evaluation. 

 

Councilman Block moved to come out of closed session at 8:51 P.M. where the council discussed the City Manager Evaluation.  Councilman Knudsen seconded the motion.  The following council members voted Yes:  Darrell Bassett, Stacey Bauer, Kevin Block, Mark Knudsen, and Harold Peterson.  No:  None.  Absent: None.  Motion declared carried.

 

Councilman Bauer moved to approve a 3% increase in salary for City Manager Harold Stewart.  Councilman Peterson seconded the motion.  It was brought to the council’s attention that the city manager salary can only be adjusted by ordinance.  Councilman Bauer withdrew his motion.  Councilman Peterson withdrew his second. 

 

There being no further business to come before the council, Councilman Peterson moved to adjourn at 8:53 P.M.  Councilman Bauer seconded the motion.  The following council members voted Yes:  Darrell Bassett, Stacey Bauer, Kevin Block, Mark Knudsen, and Harold Peterson. No: None.  Absent: None.  Motion declared carried.
