REGULAR MEETING OF THE CITY COUNCIL
JULY 28, 2009
A Regular Meeting of the City Council of the City of Ogallala, Nebraska, was held at City Hall Council Chambers in said City on the 28h day of July 2009 at 7:30 o’clock P.M. Present were: President of the Council: Darrell Bassett; Council Members: Kevin Block, Mark Knudsen, and Harold Peterson. Absent: Stacey Bauer; City Manager: Harold Stewart; City Clerk: Jane Skinner; City Attorney: Michael McQuillan.
Notice of the meeting was given in advance thereof by publishing one time in the Keith County News and posting at the City Hall Administration Building as shown by the Certificate of Publication and Posting Notice attached to these Minutes. Notice of this meeting was simultaneously given to the President and to all members of the Council on July 24, 2009 and a copy of their Acknowledgement of Receipt of Notice and the Agenda is attached to these minutes. Availability of the agenda was communicated in the advance notice and in the Notice to the President and Council of this meeting. All proceedings hereafter shown were taken while the convened meeting was open to the attendance of the public. The President of the Council stated this meeting is being convened in accordance with the Open Meetings Act and acknowledged a copy of the Open Meetings Act being duly posted in the southeast Corner of Council Chambers.
Councilman Block moved to excuse Councilman Bauer from the July 28, 2009 City Council Meeting. Councilman Peterson seconded the motion. The following council members voted Yes: Darrell Bassett, Kevin Block, Mark Knudsen, and Harold Peterson. No: None. Absent: Stacey Bauer. Motion declared carried.

Council President Bassett opened a hearing regarding a request for a Special Exception to allow a secondary residence (a tract of land located at 176 County Road West 130 legally described as a 4.22 acre tract located in the NW ¼ of the NE ¼ of Section 24, Township 14 North, Range 39 West of the 6th P.M.) at 7:33 P.M.
Ken Knoepfel, Planning and Zoning Administrator addressed the council regarding a request for a Special Exception to allow a secondary residence (a tract of land located at 176 County Road West 130 legally described as a 4.22 acre tract located in the NW ¼ of the NE ¼ of Section 24, Township 14 North, Range 39 West of the 6th P.M.) at 7:33 P.M.
Bill Hines appeared before the council regarding weeds in the City as well as the fees charged by the city for cleaning up nuisance lots.
Councilman Knudsen introduced a resolution amending the City of Ogallala Job Title Salary Range Table. Council President Bassett read the resolution and the resolution died for lack of a second.
Councilman Peterson introduced a resolution amending ambulance rates for the special fee schedule of the city of Ogallala, Nebraska. Council President Bassett read the resolution and Councilman Block seconded the motion. Upon roll call vote, the following Council Members voted “Yes”: Darrell Bassett, Kevin Block, Mark Knudsen, and Harold Peterson. The following council Members voted “No”: None. Absent: Stacey Bauer. Motion declared carried and Resolution No. 1277 adopted, a copy of said Resolution being attached hereto and by this express reference, incorporated herein and made a part hereof.

Councilman Knudsen moved to table the request for a Special Exception to allow a secondary residence (a tract of land located at 176 County Road West 130 legally described as a 4.22 acre tract located in the NW ¼ of the NE ¼ of Section 24, Township 14 North, Range 39 West of the 6th P.M.) until the August 6, 2009 Special Council Meeting.
Councilman Knudsen moved to accept the North Spruce Street project as a completed job. Councilman Block seconded the motion. The following council members voted Yes: Darrell Bassett, Kevin Block, Mark Knudsen, and Harold Peterson. No: None. Absent: Stacey Bauer. Motion declared carried.
Councilman Knudsen moved to approve North Spruce Street Pay Request No. 5 (final) for Paulsen Inc. in the amount of $85,337.48. Councilman Peterson seconded the motion. The following council members voted Yes: Darrell Bassett, Kevin Block, Mark Knudsen, and Harold Peterson. No: None. Absent: Stacey Bauer. Motion declared carried.
City Manager Stewart updated the council regarding the Canyon Road Drainage project. The project has been surveyed and the contractors have been contacted to complete the work.
Planning and Zoning Administrator Ken Knoepfel addressed the council regarding the renewal of mobile home park license for Robert Reichert dba Northwestern Mobile Home Park.
Councilman Knudsen moved to deny renewal of Mobile Home Park License for Robert Reichert dba Northwestern Mobile Home Park. Councilman Block seconded the motion. The following council members voted Yes: Darrell Bassett, Kevin Block, Mark Knudsen, and Harold Peterson. No: None. Absent: Stacey Bauer. Motion declared carried.
There being no further business to come before the council, Councilman Knudsen moved to adjourn at 8:24 P.M. Councilman Peterson seconded the motion. The following council members voted Yes: Darrell Bassett, Kevin Block, Mark Knudsen and Harold Peterson. No: None. Absent: Stacey Bauer. Motion declared carried.
