REGULAR MEETING OF THE CITY COUNCIL
AUGUST 25, 2009
A Regular Meeting of the City Council of the City of Ogallala, Nebraska, was held at City Hall Council Chambers in said City on the 25th day of August 2009 at 7:30 o’clock P.M. Present were: President of the Council: Darrell Bassett; Council Members: Stacey Bauer, and Mark Knudsen. Absent: Kevin Block and Harold Peterson; City Manager: Harold Stewart; City Clerk: Jane Skinner; City Attorney: James McQuillan.
Notice of the meeting was given in advance thereof by publishing one time in the Keith County News and posting at the City Hall Administration Building as shown by the Certificate of Publication and Posting Notice attached to these Minutes. Notice of this meeting was simultaneously given to the President and to all members of the Council on August 21, 2009 and a copy of their Acknowledgement of Receipt of Notice and the Agenda is attached to these minutes. Availability of the agenda was communicated in the advance notice and in the Notice to the President and Council of this meeting. All proceedings hereafter shown were taken while the convened meeting was open to the attendance of the public. The President of the Council stated this meeting is being convened in accordance with the Open Meetings Act and acknowledged a copy of the Open Meetings Act being duly posted in the southeast Corner of Council Chambers.
Councilman Knudsen moved to excuse Councilman Block from the August 25, 2009 City Council Meeting. Councilman Bauer seconded the motion. The following council members voted Yes: Darrell Bassett, Stacey Bauer, Mark Knudsen. No: None. Absent: Kevin Block and Harold Peterson. Motion declared carried.
Councilman Knudsen moved to remove the renewal of Mobile Home Park License for Del and Beverly Humphrey dba Hillcrest Home from the consent agenda to 6.C. on the agenda under recommendations of Departments, Boards and Committees. Councilman Bauer seconded the motion. The following council members voted Yes: Darrell Bassett, Stacey Bauer, Mark Knudsen. No: None. Absent: Kevin Block and Harold Peterson. Motion declared carried.

City Manager Stewart addressed the council regarding the sewer line near 703 West 5 Street. The replacement of this sewer line is the 2009-2010 fiscal year budget.
Pat Gamet appeared before the council regarding a Special Designated Liquor License for White Bison LLC dba 5 Trails Winery for an event to be held September 18, 2009 from 3 PM to 9 PM and September 19, 2009 from 3 PM to 9 PM.
Councilman Knudsen moved to approve a Special Designated Liquor License for White Bison LLC dba 5 Trails Winery for an event to be held September 18, 2009 from 3 PM to 9 PM and September 19, 2009 from 3 PM to 9 PM. Councilman Bauer seconded the motion. The following council members voted Yes: Darrell Bassett, Stacey Bauer, Mark Knudsen. No: None. Absent: Kevin Block and Harold Peterson. Motion declared carried.
Councilman Bauer moved to issue a livestock/fowl permit for six hens to be located at 409 East 6 Street, owned by John and Lori Carter. Councilman Knudsen seconded the motion. The following council members voted Yes: Stacey Bauer, Mark Knudsen. No: Darrell Bassett. Absent: Kevin Block and Harold Peterson. Motion declared carried.
Councilman Knudsen introduced a resolution determining final levy allocation for the Ogallala Community Redevelopment Authority. Council President Bassett read the resolution and Councilman Bauer seconded the motion. Upon roll call vote, the following Council Members voted “Yes”: Darrell Bassett, Stacey Bauer, and Mark Knudsen. The following council Members voted “No”: None. Absent: Kevin Block and Harold Peterson. Motion declared carried and Resolution No. 1279 adopted, a copy of said Resolution being attached hereto and by this express reference, incorporated herein and made a part hereof.
Jim Bischof, Economic Development Coordinator, addressed the council regarding his economic development efforts. He addressed the following topics: A meeting with the Nebraska Economic Development Field Staff; a meeting with representatives from Mid Plains Community College; plans for revamping the City Website; a business recruitment and retention meeting with the Nebraska Department of Economic Development to be held on October 13-15, 2009; Recertification of our Certified Economic Development Community; planning study for a Business incubator; retail recruitment; and an October Trade Show with Nebraska Public Power District.
Councilman Peterson entered the meeting at 7:51 P.M.
Councilman Knudsen moved to approve a Mobile Home Park License for Robert Reichert dba Northwestern Mobile Home Park pending an agreement is reached with the City regarding the installment of a new private sewer line connecting to the City’s main that is satisfactory to staff. Councilman Bauer seconded the motion. The following council members voted Yes: Darrell Bassett, Stacey Bauer, Mark Knudsen, and Harold Peterson. No: None. Absent: Kevin Block. Motion declared carried.
Councilman Bauer moved to approve a Mobile Home Park License for Del and Beverly Humphrey dba Hillcrest Homes pending an agreement is reached with Robert Reichert with respect to continuing the sewer service for a period of one year until Robert Reichert can come into compliance with city code. Councilman Peterson seconded the motion. The following council members voted Yes: Darrell Bassett, Stacey Bauer, Mark Knudsen, and Harold Peterson. No: None. Absent: Kevin Block. Motion declared carried.
City Manager Harold Stewart informed the council that the Canyon Road Drainage project has been completed.
Councilman Knudsen moved to approve Plant Demolition-Change Order Number 1 in the amount of $2,500, increasing the contract amount from $67,905.00 to $70,405.00. Councilman Peterson seconded the motion. The following council members voted Yes: Darrell Bassett, Stacey Bauer, Mark Knudsen, and Harold Peterson. No: None. Absent: Kevin Block. Motion declared carried.
Jeff Ahl, Jeo Consulting Group, Inc. appeared before the council presenting the conceptual design of the proposed community center and described the different delivery methods available for construction.
Mary Lou Heelan addressed the council regarding the community center. Mrs. Heelan pledged $1,000 to the city, if the city would break ground within the next 12 months for the addition to the current Goodall Recreation Center.
There being no further business to come before the council, Councilman Bauer moved to adjourn at 8:43 P.M. Councilman Knudsen seconded the motion. The following council members voted Yes: Darrell Bassett, Stacey Bauer, Mark Knudsen and Harold Peterson. No: None. Absent: Kevin Block. Motion declared carried.
