REGULAR MEETING OF THE CITY COUNCIL

 

SEPTEMBER 22, 2009

 

A Regular Meeting of the City Council of the City of Ogallala, Nebraska, was held at City Hall Council Chambers in said City on the 22nd day of September 2009 at 7:30 o’clock P.M.  Present were:  President of the Council:  Darrell Bassett; Council Members:  Stacey Bauer, Kevin Block, Mark Knudsen and.Harold Peterson.  Absent:  None; City Manager:  Harold Stewart; City Clerk:  Jane Skinner; City Attorney:  Michael McQuillan.

 

Notice of the meeting was given in advance thereof by publishing one time in the Keith County News and posting at the City Hall Administration Building as shown by the Certificate of Publication and Posting Notice attached to these Minutes.  Notice of this meeting was simultaneously given to the President and to all members of the Council on September 18, 2009 and a copy of their Acknowledgement of Receipt of Notice and the Agenda is attached to these minutes.  Availability of the agenda was communicated in the advance notice and in the Notice to the President and Council of this meeting.  All proceedings hereafter shown were taken while the convened meeting was open to the attendance of the public.  The President of the Council stated this meeting is being convened in accordance with the Open Meetings Act and acknowledged a copy of the Open Meetings Act being duly posted in the southeast Corner of Council Chambers.

 

Councilman Knudsen moved to remove the check payable to BG&S Transmissions in the amount of $2,895.00.  Councilman Block seconded the motion.  The following council members voted Yes:  Darrell Bassett, Kevin Block, Stacey Bauer, Mark Knudsen and Harold Peterson.  No: None.  Absent:  None.  Motion declared carried.

 

Councilman Block moved to approve the consent agenda.  Councilman Peterson seconded the motion.  The following council members voted Yes:  Darrell Bassett, Kevin Block, Stacey Bauer, Mark Knudsen and Harold Peterson.  No: None.  Absent:  None.  Motion declared carried and the consent agenda was approved as follows:

Council President Bassett recognized Dan Willey for 20 Years of Service to the City of Ogallala.

 

Council President Bassett recognized Bernice Wilson for 20 Years of Service to the City of Ogallala.

 

Council President Bassett announced Ordinance 1266 was introduced and read for the first time on September 8, 2009.  Council President Bassett read Ordinance 1266 by title, An ordinance of the City of Ogallala, Nebraska, establishing a cell phone occupation tax; providing exceptions thereto; providing for payment of same; providing for reporting and examination of records; and repealing any other ordinances or provisions in conflict therewith.  Council President Bassett announced that Ordinance 1266 was read for the second time.

 

Wayne Canning addressed the council regarding the proposed Cell Phone Occupation Tax.

 

Councilman Knudsen moved to approve 6-Place T-Hangar Change Order Number 1 changing the contract amount with Mike Smith Construction Inc. from $613,590.00 to $639,195.30, a difference of $25,605.30.  Councilman Bauer seconded the motion.  The following council members voted Yes:  Darrell Bassett, Kevin Block, Stacey Bauer, Mark Knudsen and Harold Peterson.  No: None.  Absent:  None.  Motion declared carried.

 

Stephanie Most appeared before the council regarding the proposed BECA (Building Entrepreneurial Communities Act) grant application.

 

Councilman Knudsen introduced a resolution applying for assistance from the Building Entrepreneurial Communities Act for the purpose of seeking marketing assistance to attract new residents from outside the State of Nebraska by the City of Ogallala, Nebraska.  Council President Bassett read the resolution and Councilman Block seconded the motion.  Upon roll call vote, the following Council Members voted “Yes”:  Darrell Bassett, Kevin Block, Stacey Bauer, Mark Knudsen and Harold Peterson.  The following council Members voted “No”:  None.  Absent:  None.   Motion declared carried and Resolution No. 1283 adopted, a copy of said Resolution being attached hereto and by this express reference, incorporated herein and made a part hereof.

 

Councilman Bauer moved to approve the recommendation of the City Manager that Jacob Mueller be appointed to the Ogallala Community Redevelopment Authority Board for a five year term on September 30, 2014.  Councilman Peterson seconded the motion.  The following council members voted Yes:  Darrell Bassett, Kevin Block, Stacey Bauer, Mark Knudsen and Harold Peterson.  No: None.  Absent:  None.  Motion declared carried.

 

Bill Fortune, Fire Chief, addressed the council regarding the specifications and bid advertising and opening dates for Walk Around Heavy Rescue Truck.

 

Councilman Bauer moved to approve the Specifications and Bid Advertising and Opening Dates for a Rescue Truck as recommended by Staff and to establish the Bid Opening date as December 1, 2009 at 3:00 pm.  Councilman Peterson seconded the motion.  The following council members voted Yes:  Darrell Bassett, Kevin Block, Stacey Bauer, Mark Knudsen and Harold Peterson.  No: None.  Absent:  None.  Motion declared carried.

 

Dave Kling, Police Chief, addressed the council regarding an interlocal agreement with Keith County creating the Keith County Emergency Response Team.

 

Councilman Knudsen moved to approve the Interlocal Agreement with Keith County creating the Keith County Emergency Response Team.  Councilman Bauer seconded the motion.  The following council members voted Yes:  Darrell Bassett, Kevin Block, Stacey Bauer, Mark Knudsen and Harold Peterson.  No: None.  Absent:  None.  Motion declared carried.

 

City Manager Stewart addressed the council regarding the renewal of his employment contract.

 

Councilman Peterson moved to not renew the contract with the City Manager and allow it to expire on December 31, 2009.  Motion died for lack of a second.

 

There being no further business to come before the council, Councilman Peterson moved to adjourn at 8:00 P.M.  Councilman Bauer seconded the motion.  The following council members voted Yes:  Darrell Bassett, Stacey Bauer, Kevin Block, Mark Knudsen and Harold Peterson. No: None.  Absent:  None.  Motion declared carried.
