REGULAR MEETING OF THE CITY COUNCIL
NOVEMBER 24, 2009
A Regular Meeting of the City Council of the City of Ogallala, Nebraska, was held at City Hall Council Chambers in said City on the 24th day of November 2009 at 7:30 o’clock P.M. Present were: President of the Council: Darrell Bassett; Council Members: Stacey Bauer, Kevin Block, Mark Knudsen and Harold Peterson. Absent: None; City Manager: Harold Stewart; City Clerk: Jane Skinner; City Attorney: Michael McQuillan.
Notice of the meeting was given in advance thereof by publishing one time in the Keith County News and posting at the City Hall Administration Building as shown by the Certificate of Publication and Posting Notice attached to these Minutes. Notice of this meeting was simultaneously given to the President and to all members of the Council on November 20, 2009 and a copy of their Acknowledgement of Receipt of Notice and the Agenda is attached to these minutes. Availability of the agenda was communicated in the advance notice and in the Notice to the President and Council of this meeting. All proceedings hereafter shown were taken while the convened meeting was open to the attendance of the public. The President of the Council stated this meeting is being convened in accordance with the Open Meetings Act and acknowledged a copy of the Open Meetings Act being duly posted in the southeast Corner of Council Chambers.
Councilman Block moved to approve the consent agenda. Councilman Bauer seconded the motion. The following council members voted Yes: Darrell Bassett, Kevin Block, Stacey Bauer, Mark Knudsen and Harold Peterson. No: None. Absent: None. Council President Bassett recognized Gerald Dealey for 15 years of service to the City of Ogallala.
Councilman Peterson moved to approve the Owner Occupied Credit Line Promissory Note for Case No. CDBG 08-HO-3073-04 and Owner Occupied Housing Rehabilitation Program Credit Line Promissory Note for Case No. CDBG 08-HO-3073-05 and Owner Occupied Housing Rehabilitation Program Credit Line Promissory Note for Case No. CDBG 08-HO-3073-06 and Owner Occupied Housing Rehabilitation Program Credit Line Promissory Note for Case No. CDBG 08-HO-3073-07. Councilman Knudsen seconded the motion. The following council members voted Yes: Darrell Bassett, Kevin Block, Stacey Bauer, Mark Knudsen and Harold Peterson. No: None. Absent: None. Motion declared carried.
Councilman Peterson moved to approve Owner Occupied Housing Rehabilitation Program Rehabilitation Contract for Case No. CDBG 08-HO-3073-04 and Mark Davis of Davis Construction in the amount of $6,966.00 and Owner Occupied Housing Rehabilitation Program Rehabilitation Contract for Case No. CDBG 08-HO-3073-05 and Dave Melchior of Melchior & Associatesin the amount of $19,500.00 and Owner Occupied Housing Rehabilitation Program Rehabilitation Contract for Case No. CDBG 08-HO-3073-06 and Mark Davis of Davis Construction in the amount of $19,750.00 and Owner Occupied Housing Rehabilitation Program Rehabilitation Contract for Case No. CDBG 08-HO-3073-07 and Doug Wasserman of Unlimited Access, LLC in the amount of $18,992.00. Jim Bischof, Economic Development Coordinator addressed the council regarding recent economic development efforts. Topics include the recent Business visitation program; the World Food Expo in Chicago; EDI Training; Relocation of the water main near Big Mac Marine; and the development of a new city website.
Brad Bauer addressed the council expressing thanks to the City Council for the work on the water main relocation project near Big Mac Marine.
Councilman Knudsen moved to approve and accept the Wastewater-Treatment Plant Demolition as complete. Councilman Block seconded the motion. The following council members voted Yes: Darrell Bassett, Kevin Block, Stacey Bauer, Mark Knudsen and Harold Peterson. No: None. Absent: None. Motion declared carried.
Councilman Knudsen moved to approve Wastewater-Treatment Plant Demolition- Pay Request No. 1 (final) for Regier Land Improvement in the amount of $70,405.00. Councilman Peterson seconded the motion. The following council members voted Yes: Darrell Bassett, Kevin Block, Stacey Bauer, Mark Knudsen and Harold Peterson. No: None. Absent: None. Motion declared carried.
The Water Main located near 418 East 1 Street (Old Hardware Hank Building) was discussed. This item will be placed on the agenda for the December 8 Council Meeting.
Councilman Knudsen moved to send a letter to the State Legislature in regards to the Sales Tax collection as proposed by Senator Rich Pahls and signed by all of the Council Members. Councilman Block seconded the motion. The following council members voted Yes: Darrell Bassett, Kevin Block, Stacey Bauer, Mark Knudsen and Harold Peterson. No: None. Absent: None. Motion declared carried.
Councilman Block moved to go into closed session to conduct the city manager annual evaluation. Councilman Knudsen seconded the motion. The following council members voted Yes: Darrell Bassett, Kevin Block, Stacey Bauer, Mark Knudsen and Harold Peterson. No: None. Absent: None. Motion declared carried.
Council President Bassett announced that the Council will now go into closed session to conduct the city manager annual evaluation, at 8:01 P.M.
Councilman Knudsen moved to return from closed session where discussion of the city manager annual evaluation occurred at 9:24 P.M. Councilman Block seconded the motion. The following council members voted Yes: Darrell Bassett, Kevin Block, Stacey Bauer, Mark Knudsen and Harold Peterson. No: None. Absent: None. Motion declared carried
There being no further business to come before the council, Councilman Block moved to adjourn at 9:24 P.M. Councilman Bauer seconded the motion.
