REGULAR MEETING OF THE CITY COUNCIL
JULY 27, 2010
A Regular Meeting of the City Council of the City of Ogallala, Nebraska, was held at City Hall Council Chambers in said City on the 27th day of July 2010 at 7:30 o’clock P.M. Present were: President of the Council: Darrell Bassett; Council Members: Kevin Block, Mark Knudsen and Harold Peterson. Absent: Stacey Bauer; City Manager: Harold Stewart; City Clerk: Jane Skinner; City Attorney: Jim McQuillan.
Notice of the meeting was given in advance thereof by publishing one time in the Keith County News and posting at the City Hall Administration Building as shown by the Certificate of Publication and Posting Notice attached to these Minutes. Notice of this meeting was simultaneously given to the President and to all members of the Council on July 23, 2010 and a copy of their Acknowledgement of Receipt of Notice and the Agenda is attached to these minutes. Availability of the agenda was communicated in the advance notice and in the Notice to the President and Council of this meeting. All proceedings hereafter shown were taken while the convened meeting was open to the attendance of the public. The President of the Council stated this meeting is being convened in accordance with the Open Meetings Act and acknowledged a copy of the Open Meetings Act being duly posted in the southeast Corner of Council Chambers.
Councilman Block moved to excuse Councilman Bauer from the July 27, 2010 City Council Meeting. Councilman Peterson seconded the motion. The following council members voted Yes: Darrell Bassett, Kevin Block, Mark Knudsen and Harold Peterson. No: None. Absent: Stacey Bauer. Motion declared carried.
Councilman Knudsen moved to remove #5 Erlewine Court from the consent agenda under item 1.A. Community Development – Demolition Agreement - Neighborhood Stabilization Program. Councilman Peterson seconded the motion. The following council members voted Yes: Darrell Bassett, Kevin Block, Mark Knudsen and Harold Peterson. No: None. Absent: Stacey Bauer. Motion declared carried.

Council President Bassett opened a public hearing regarding the Class D Liquor License for House of Bottles at 7:34 P.M.
The Minutes of the Regular Meeting held on June 22, 2010 were tabled until the next meeting.
Councilman Block move to approve the minutes of the regular meeting held on July 13, 2010. Councilman Knudsen seconded the motion. The following council members voted Yes: Darrell Bassett, Kevin Block, and Mark Knudsen. No: None. Abstain: Harold Peterson. Absent: Stacey Bauer. Motion declared carried.
Councilman Peterson moved to approve the minutes of the special meeting held on July 16, 2010. Councilman Knudsen seconded the motion. The following council members voted Yes: Darrell Bassett, Mark Knudsen and Harold Peterson. No: None. Abstain: Kevin Block. Absent: Stacey Bauer. Motion declared carried.
Council President Bassett closed a public hearing regarding the Class D Liquor License for House of Bottles at 7:37 P.M.
Councilman Knudsen moved to recommend approval to the Nebraska Liquor Commission for the Class D Liquor License for House of Bottles. Councilman Peterson seconded the motion. The following council members voted Yes: Darrell Bassett, Kevin Block, Mark Knudsen and Harold Peterson. No: None. Absent: Stacey Bauer. Motion declared carried.
Councilman Knudsen moved to recommend approval to the Nebraska Liquor Commission of a Corporate Manager License for William Terry in connection with the Class D Liquor License of House of Bottles. Councilman Block seconded the motion. The following council members voted Yes: Darrell Bassett, Kevin Block, Mark Knudsen and Harold Peterson. No: None. Absent: Stacey Bauer. Motion declared carried.
Councilman Knudsen moved to approve the Council President to execute the necessary documents for acceptance of the Energy Efficiency and Conservation Block Grant and for the city manager to execute any documents necessary for compliance and administration of the grant. Councilman Peterson seconded the motion. The following council members voted Yes: Darrell Bassett, Kevin Block, Mark Knudsen and Harold Peterson. No: None. Absent: Stacey Bauer. Motion declared carried.
Councilman Peterson moved to accept Nebraska State Patrol Hangar Project H-03 Certificate of Completion. Councilman Block seconded the motion. The following council members voted Yes: Darrell Bassett, Kevin Block, Mark Knudsen and Harold Peterson. No: None. Absent: Stacey Bauer. Motion declared carried.
Councilman Knudsen moved to approve Nebraska State Patrol Hangar Project H-03 Pay Request 6 (final) for Paul Reed Construction & Supply, Inc. in the amount of $7,555.75. Councilman Block seconded the motion. The following council members voted Yes: Darrell Bassett, Kevin Block, Mark Knudsen and Harold Peterson. No: None. Absent: Stacey Bauer. Motion declared carried.
Carter Hubbard of Olsson and Associates addressed the council regarding the storm water Drainage Issue by Green Acres Mobile Home Court. Mike Mell appeared before the council regarding the drainage issue also.
Tom Satchell of Jacobson Satchell addressed the council regarding the Ultraviolet Disinfection System for the Waste Water Treatment Plant.
Tom Satchell of Jacobson Satchell updated the council on the Variable Frequency Drives at the Northeast Wellfield. John Sauer, Water Superintendent also addressed the council regarding the Variable Frequency Drives at the Northeast Wellfield.
Councilman Peterson moved to amend the contract with Ergon Kinetos Systems, Inc dba Kenfield Electric in the amount of $13,728.00 to put in two monitoring wells and installation of transducers. Councilman Block seconded the motion. The following council members voted Yes: Darrell Bassett, Kevin Block, Mark Knudsen and Harold Peterson. No: None. Absent: Stacey Bauer. Motion declared carried.
City Manager Stewart informed the council of correspondence received from the firm Dudden & Fair on behalf of Dee and Steve McCroden regarding drainage near their home.
City Manager Stewart presented revenue projections for the upcoming budget year, as well as the recommended budget to the council.
Dennis Maggart updated the council regarding health care benefits options available to the City of Ogallala.
There being no further business to come before the council, Councilman Block moved to adjourn at 9:29 P.M. Councilman Peterson seconded the motion. The following council members voted Yes: Darrell Bassett, Kevin Block, Mark Knudsen and Harold Peterson. No: None. Absent: Stacey Bauer. Motion declared carried.
