REGULAR MEETING OF THE CITY COUNCIL

 

NOVEMBER 23, 2010

 

A Regular Meeting of the City Council of the City of Ogallala, Nebraska, was held at City Hall Council Chambers in said City on the 23th day of November 2010, at 7:30 o’clock P.M.  Present were:  President of the Council: Darrell G. Bassett; Council Members: Stacey Bauer, Kevin Block, and Mark Knudsen.  Absent:  Harold Peterson. City Manager: Harold Stewart; City Clerk: Jane M. Skinner; City Attorney:  Michael McQuillan.

 

Notice of the meeting was given in advance thereof by publishing one time in the Keith County News and posting at the City Hall Administration Building as shown by the Certificate of Publication and Posting Notice attached to these Minutes.  Notice of this meeting was simultaneously given to the President and to all members of the Council on November 19, 2010 and a copy of their Acknowledgement of Receipt of Notice and the Agenda is attached to these minutes.  Availability of the agenda was communicated in the advance notice and in the Notice to the President and Council of this meeting.  All proceedings hereafter shown were taken while the convened meeting was open to the attendance of the public.  The President of the Council stated this meeting is being convened in accordance with the Open Meetings Act and acknowledged a copy of the Open Meetings Act being duly posted in the southeast Corner of Council Chambers.

 

Councilman Block moved to excuse Councilman Peterson from the November 23, 2010 City Council Meeting.  Councilman Bauer seconded them motion.  The following council members voted Yes:  Darrell Bassett, Stacey Bauer, Kevin Block, and Mark Knudsen.  No:  None.  Absent:  Harold Peterson.  Motion declared carried.

 

Councilman Block moved to approve the consent agenda.  Councilman Bauer seconded the motion.  The following council members voted Yes:  Darrell Bassett, Stacey Bauer, Kevin Block, and Mark Knudsen.  No:  None.  Absent:  Harold Peterson.  Motion declared carried and the consent agenda was approved as follows:

Council President Bassett opened a public hearing regarding an ordinance amending section 18-102 and 18-103 of the Ogallala Municipal Code governing dates and times when fireworks are permitted to be sold and discharged at 7:32 P.M.

 

Ken Knoepfel, Planning and Zoning Administrator and Chelsey Hornbacker addressed the council regarding the proposed ordinance amending section 18-102 and 18-103 of the Ogallala Municipal Code governing dates and times when fireworks are permitted to be sold and discharged.

 

 Council President Bassett recognized Noni Thiesen for her 10 years of service to the City of Ogallala.

 

Council President Bassett recognized Mike Bell for his service as Interim Fire Chief.

 

City Manager Harold Stewart introduced Greg Stofer as the new Fire Chief in Ogallala.

 

Councilman Knudsen moved to approve the minutes of the regular meeting held on November 9, 2010.  Councilman Block seconded the motion.  The following council members voted Yes:  Darrell Bassett, Kevin Block, and Mark Knudsen.  No:  None.  Abstain:   Stacey Bauer.  Absent:  Harold Peterson.  Motion declared carried.

 

C.J. Poltack representing West Central Nebraska Development District addressed the council regarding the Certification of Local Government Review for a Community Development Assistance Act Application for Keith County Area Development (Mid-Plains Community College). 

 

Councilman Knudsen moved to approve the Certification of Local Government Review for a Community Development Assistance Act (CDAA) Application for Keith County Area Development (Mid-Plains Community College).  Councilman Block seconded the motion.  The following council members voted Yes:  Darrell Bassett, Stacey Bauer, Kevin Block, and Mark Knudsen.  No:  None.  Absent:  Harold Peterson.  Motion declared carried.

 

Councilman Bauer moved to approve the amendment of Keno Fund Payment Agreement with Keith County Area Development, Inc. for Eligible Infrastructure Improvement Expenses as presented.  Councilman Knudsen seconded the motion.  The following council members voted Yes:  Darrell Bassett, Stacey Bauer, Kevin Block, and Mark Knudsen.  No:  None.  Absent:  Harold Peterson.  Motion declared carried.

 

Councilman Knudsen moved to approve an amendment of Keno Fund Payment Agreement with Kenfield Petrified Wood Gallery for renovation of 418 East 1st Street, Ogallala, Nebraska as presented.  Councilman Bauer seconded the motion.  The following council members voted Yes:  Darrell Bassett, Stacey Bauer, Kevin Block, and Mark Knudsen.  No:  None.  Absent:  Harold Peterson.  Motion declared carried.

 

Councilman Knudsen moved to approve an amendment of the Silver Sneakers Agreement as presented.  Councilman Block seconded the motion.  The following council members voted Yes:  Darrell Bassett, Stacey Bauer, Kevin Block, and Mark Knudsen.  No:  None.  Absent:  Harold Peterson.  Motion declared carried.

 

Councilman Knudsen introduced Ordinance 1274, entitled:  An ordinance amending Section 18-102 and 18-103 of the Ogallala Municipal Code governing dates and times when fireworks are permitted to be sold and discharged and moved that the Statutory Rule requiring the reading on three different days be suspended.  Councilman Block seconded the motion.  Upon roll call vote, the following Council Members voted “Yes”: Stacey Bauer, Kevin Block, and Mark Knudsen.  The following Council Members voted “No”:  Darrell Bassett.  Absent:  Harold Peterson.  Motion declared carried and the Statutory Rule was declared suspended for the consideration of this Ordinance.

 

Ordinance No. 1274 was read by title and, thereafter, Councilman Knudsen moved for the final passage of the Ordinance.  Councilman Block seconded the motion.  The President then stated the question:  “Shall Ordinance No. 1274 be passed and adopted?”  Upon roll call vote, the following Council Members voted “Yes”:  Darrell Bassett, Stacey Bauer, Kevin Block, and Mark Knudsen.  The following Council Members voted “No”:  None.  Absent:  Harold Peterson.  The passage and adoption of said Ordinance having been concurred in by a majority of all members of the Council, the President declared the Ordinance adopted and the President, in the presence of the Council, signed and approved the Ordinance and the Clerk attested to the passage and approval of the same and affixed her signature thereto, a copy of said Ordinance No. 1274 being attached hereto and, by this express reference, incorporated herein and made a part hereof.

 

Councilman Knudsen moved to approve $60.00 Chamber Bucks bonus to all permanent full time employees, a $10.00 Chamber Bucks bonus to all permanent part time employees and a $40.00 Chamber Bucks bonus to all volunteer firefighters.  Councilman Bauer seconded the motion.  The following council members voted Yes:  Darrell Bassett, Stacey Bauer, Kevin Block, and Mark Knudsen.  No:  None.  Absent:  Harold Peterson.  Motion declared carried.

 

Dave Kling, Chief of Police, addressed the council regarding the interpretation of Ogallala Municipal Code 27-104(1)(a) – Hanging of deer/coyote carcasses in city limits. 

 

Councilman Bauer moved to direct staff to prepare an amendment to the Municipal Code to allow for the hanging of harvested animals during hunting seasons.  Councilman Block seconded the motion.  The following council members voted Yes:  Darrell Bassett, Kevin Block, Stacey Bauer, and Mark Knudsen.  No: None.  Absent:  Harold Peterson.  Motion declared carried

 

Councilman Knudsen moved to go into closed session to conduct the city manager annual evaluation at 8:24 P.M.  Councilman Bauer seconded the motion.  The following council members voted Yes:  Darrell Bassett, Kevin Block, Stacey Bauer, and Mark Knudsen.  No: None.  Absent:  Harold Peterson.  Motion declared carried.

 

Council President Bassett announced that the Council will now go into closed session to conduct the city manager annual evaluation, at 8:24 P.M. 

 

Councilman Knudsen moved to return from closed session, where discussion of the city manager annual evaluation occurred, at 9:27 P.M.  Councilman Bauer seconded the motion.  The following council members voted Yes:  Darrell Bassett, Kevin Block, Stacey Bauer, and Mark Knudsen.  No: None.  Absent:  Harold Peterson.  Motion declared carried

 

There being no further business to come before the council, Councilman Knudsen moved to adjourn.  Councilman Block seconded the motion.  The following council members voted Yes:  Darrell Bassett, Stacey Bauer, Kevin Block, and Mark Knudsen.  No:  None.  Absent:  Harold Peterson.  Motion declared carried and the meeting adjourned at 9:28 P.M.
