REGULAR MEETING OF THE CITY COUNCIL

 

DECEMBER 28, 2010

 

A Regular Meeting of the City Council of the City of Ogallala, Nebraska, was held at City Hall Council Chambers in said City on the 28th day of December 2010, at 7:30 o’clock P.M.  Present were:  President of the Council: Darrell G. Bassett; Council Members: Stacey Bauer, Kevin Block and Harold Peterson.  Absent:  Mark Knudsen. City Manager: Harold Stewart; City Clerk: Jane M. Skinner; City Attorney:  Michael McQuillan.

 

Notice of the meeting was given in advance thereof by publishing one time in the Keith County News and posting at the City Hall Administration Building as shown by the Certificate of Publication and Posting Notice attached to these Minutes.  Notice of this meeting was simultaneously given to the President and to all members of the Council on December 23, 2010 and a copy of their Acknowledgement of Receipt of Notice and the Agenda is attached to these minutes.  Availability of the agenda was communicated in the advance notice and in the Notice to the President and Council of this meeting.  All proceedings hereafter shown were taken while the convened meeting was open to the attendance of the public.  The President of the Council stated this meeting is being convened in accordance with the Open Meetings Act and acknowledged a copy of the Open Meetings Act being duly posted in the southeast Corner of Council Chambers.

 

Councilman Block moved to excuse Mark Knudsen from the December 28, 2010 City Council Meeting.  Councilman Peterson seconded the motion.  The following council members voted Yes:  Darrell Bassett, Stacey Bauer, Kevin Block and Harold Peterson.  No:  None.  Absent:  Mark Knudsen.  Motion declared carried.

 

Councilman Peterson moved to approve the consent agenda.  Councilman Block seconded the motion. The following council members voted Yes:  Darrell Bassett, Stacey Bauer, Kevin Block and Harold Peterson.  No:  None.  Absent:  Mark Knudsen.  Motion declared carried and the consent agenda was approved as follows:

Councilman Bauer moved to approve the minutes of the regular meeting held December 14, 2010.  Councilman Peterson seconded the motion.  The following council members voted Yes:  Darrell Bassett, Stacey Bauer and Harold Peterson.  No:  None.  Abstain:  Kevin Block.  Absent:  Mark Knudsen.  Motion declared carried.

 

Councilman Block introduced Ordinance 1275, entitled:  A Franchise Ordinance of the City of Ogallala, Nebraska granting a cable television franchise to Charter Communications VI, LLC, d/b/a Charter Communications, for the further development and continued operation of a cable system and moved that the Statutory Rule requiring the reading on three different days be suspended.  Councilman Bauer seconded the motion.  Upon roll call vote, the following Council Members voted “Yes”: Darrell Bassett, Stacey Bauer, Kevin Block, and Harold Peterson.  The following Council Members voted “No”:   Absent:  Mark Knudsen.  Motion declared carried and the Statutory Rule was declared suspended for the consideration of this Ordinance.

 

Ordinance No. 1275 was read by title and, thereafter, Councilman Peterson moved for the final passage of the Ordinance.  Councilman Block seconded the motion.  The President then stated the question:  “Shall Ordinance No. 1275 be passed and adopted?”  Upon roll call vote, the following Council Members voted “Yes”:  Darrell Bassett, Stacey Bauer, Kevin Block, and Harold Peterson.  The following Council Members voted “No”:  None.  Absent:  Mark Knudsen.  The passage and adoption of said Ordinance having been concurred in by a majority of all members of the Council, the President declared the Ordinance adopted and the President, in the presence of the Council, signed and approved the Ordinance and the Clerk attested to the passage and approval of the same and affixed her signature thereto, a copy of said Ordinance No. 1275 being attached hereto and, by this express reference, incorporated herein and made a part hereof.

 

Councilman Bauer moved to approve the Settlement and Release Agreement with Charter Communications VI, LLC, d/b/a Charter Communications.  Councilman Peterson seconded the motion.  The following council members voted Yes:  Darrell Bassett, Stacey Bauer, Kevin Block and Harold Peterson.  No:  None.  Absent:  Mark Knudsen.  Motion declared carried.

 

No action was taken on the Budget Amendment to the 08-HO-3073 Owner Occupied Housing Contract at the request of West Central Development District.

 

CJ Poltack addressed the council regarding the  CDBG 10-DTR-008 (Downtown Revitalization).

 

Councilman Bauer moved to approve CDBG 10-DTR-008 (Downtown Revitalization) Special Conditions for Release of Funds: Grantee Info Sheet; Environmental Review; Authorization to request funds form, Financial Management; Procurement Standards; Excessive Force Certification; Fair Housing; Implementation Schedule.  Councilman Block seconded the motion.  The following council members voted Yes:  Darrell Bassett, Stacey Bauer, Kevin Block and Harold Peterson.  No:  None.  Absent:  Mark Knudsen.  Motion declared carried.

 

Councilman Peterson moved to approve the Interlocal Agreement with Ogallala Rural Fire District regarding the Rescue Truck.  Councilman Block seconded the motion.  The following council members voted Yes:  Darrell Bassett, Stacey Bauer, Kevin Block and Harold Peterson.  No:  None.  Absent:  Mark Knudsen.  Motion declared carried.

 

Councilman Block introduced a resolution authorizing a contract for loan between the Nebraska Department of Environmental Quality and the City of Ogallala for improvements to the sewer system in the City of Ogallala, Nebraska.   Council President Bassett read the resolution by title and Councilman Bauer seconded the motion.  Upon roll call vote, the following Council Members voted “Yes”:  Darrell Bassett, Stacey Bauer, Kevin Block and Harold Peterson.  The following council Members voted “No”:  None.  Absent: Mark Knudsen.   Motion declared carried and Resolution No. 1315 adopted, a copy of said Resolution being attached hereto and by this express reference, incorporated herein and made a part hereof.

 

There being no further business to come before the council, Councilman Peterson moved to adjourn.  Councilman Bauer seconded the motion.  The following council members voted Yes:  Darrell Bassett, Stacey Bauer, Kevin Block and Harold Peterson.  No:  None.  Absent:  Mark Knudsen.  Motion declared carried and the meeting adjourned at 7:49 P.M.
