REGULAR MEETING OF THE CITY COUNCIL

 

MARCH 22, 2011

 

A Regular Meeting of the City Council of the City of Ogallala, Nebraska, was held at City Hall Council Chambers in said City on the 22nd day of March 2011, at 7:30 o’clock P.M.  Present were:  President of the Council: Darrell G. Bassett; Council Members: Stacey Bauer Kevin Block Mark Knudsen and Harold Peterson.  Absent: None. City Manager: Harold Stewart; City Clerk: Jane M. Skinner; City Attorney:  Michael McQuillan.

 

Notice of the meeting was given in advance thereof by publishing one time in the Keith County News and posting at the City Hall Administration Building as shown by the Certificate of Publication and Posting Notice attached to these Minutes.  Notice of this meeting was simultaneously given to the President and to all members of the Council on March 18, 2011 and a copy of their Acknowledgement of Receipt of Notice and the Agenda is attached to these minutes.  Availability of the agenda was communicated in the advance notice and in the Notice to the President and Council of this meeting.  All proceedings hereafter shown were taken while the convened meeting was open to the attendance of the public.  The President of the Council stated this meeting is being convened in accordance with the Open Meetings Act and acknowledged a copy of the Open Meetings Act being duly posted in the southeast Corner of Council Chambers.

 

Councilman Block moved to approve the minutes of the regular meeting held February 22, 2011.  Councilman Knudsen seconded the motion.  The following council members voted Yes:  Darrell Bassett, Kevin Block, and Mark Knudsen.  No:  None.  Absent:  None.  Abstain:  Stacey Bauer and Harold Peterson.  Motion declared carried. 

 

City Clerk Skinner presented the financial report for February 2011. 

 

Councilman Knudsen moved to approve the claims.  Councilman Peterson seconded the motion.  The following council members voted Yes:  Darrell Bassett, Stacey Bauer, Kevin Block, Mark Knudsen, and Harold Peterson.  No:  None.  Absent:  None.  Abstain:  None.  Motion declared carried.

Councilman Bauer moved to approve a Plumbing Contractor License for James Wintholz.  Councilman Block seconded the motion.  The following council members voted Yes:  Darrell Bassett, Stacey Bauer, Kevin Block, Mark Knudsen, and Harold Peterson.  No:  None.  Absent:  None.  Motion declared carried. 

 

Councilman Knudsen moved to approve a License or Permit Bond for Christopher Wenztle of P&L Contractors.  Councilman Block seconded the motion.  The following council members voted Yes:  Darrell Bassett, Stacey Bauer, Kevin Block, Mark Knudsen, and Harold Peterson.  No:  None.  Absent:  None.  Motion declared carried. 

 

Brian Vasa addressed the council regarding the Community Redevelopment Authority Redevelopment Project (Godfather’s Pizza).

 

Councilman Knudsen moved to approve the Community Redevelopment Authority Redevelopment Project for Godfather’s Pizza.  Councilman Peterson seconded the motion.  The following council members voted Yes:  Darrell Bassett, Stacey Bauer, Kevin Block, Mark Knudsen, and Harold Peterson.  No:  None.  Absent:  None.  Motion declared carried.

 

Randy Fair and Kim Morrell addressed the council regarding the Goodall Recreation Center Expansion Contract Award.

 

Councilman Bauer moved to approve awarding a contract for the Goodall Recreation Center – Rec Center Expansion to RBP Construction/Moul’s Modern Builders in the amount of $649,675.00.  Councilman Block seconded the motion.  The following council members voted Yes:  Darrell Bassett, Stacey Bauer, Kevin Block, Mark Knudsen, and Harold Peterson.  No:  None.  Absent:  None.  Motion declared carried.

 

Police Chief Dave Kling presented the annual report for the Ogallala Police Department for 2010.

 

Councilman Knudsen introduced Ordinance 1277, entitled:  An ordinance amending Section 7-104 adoption of Life Safety Code of the Municipal Code of the City of Ogallala, Nebraska, and moved that the Statutory Rule requiring the reading on three different days be suspended.  Councilman Block seconded the motion.  Upon roll call vote, the following Council Members voted “Yes”: Darrell Bassett, Kevin Block, Mark Knudsen.  The following Council Members voted “No”:  Stacey Bauer and Harold Peterson.  Absent:  None.  Motion declared carried and the Statutory Rule was declared suspended for the consideration of this Ordinance.

 

Ordinance No. 1277 was read by title and, thereafter, Councilman Block moved for the final passage of the Ordinance.  Councilman Knudsen seconded the motion.  The President then stated the question:  “Shall Ordinance No. 1277 be passed and adopted?”  Upon roll call vote, the following Council Members voted “Yes”:  Darrell Bassett, Kevin Block, and Mark Knudsen.  The following Council Members voted “No”:  Stacey Bauer and Harold Peterson.  Absent:  None.  The passage and adoption of said Ordinance having been concurred in by a majority of all members of the Council, the President declared the Ordinance adopted and the President, in the presence of the Council, signed and approved the Ordinance and the Clerk attested to the passage and approval of the same and affixed her signature thereto, a copy of said Ordinance No. 1277 being attached hereto and, by this express reference, incorporated herein and made a part hereof.

 

Councilman Peterson moved to approve a renewal rider with Union Pacific Railroad for public access of Riverdale Drive through December 31, 2011.  Councilman Bauer seconded the motion.  The following council members voted Yes:  Darrell Bassett, Stacey Bauer, Kevin Block, Mark Knudsen, and Harold Peterson.  No:  None.  Absent:  None.  Motion declared carried.

 

Councilman Peterson moved to approve Maintenance Agreement No. 43 between the Nebraska Department of Roads and the City of Ogallala, Nebraska for calendar year 2011.  Councilman Knudsen seconded the motion.  The following council members voted Yes:  Darrell Bassett, Stacey Bauer, Kevin Block, Mark Knudsen, and Harold Peterson.  No:  None.  Absent:  None.  Motion declared carried.

 

There being no further business to come before the council, Councilman Knudsen moved to adjourn.  Councilman Block seconded the motion.  The following council members voted Yes:  Darrell Bassett, Stacey Bauer, Kevin Block, Mark Knudsen, and Harold Peterson.  No:  None.  Absent:  None.  Motion declared carried and the meeting adjourned at 8:22 P.M.
