REGULAR MEETING OF THE CITY COUNCIL
APRIL 12, 2011
A Regular Meeting of the City Council of the City of Ogallala, Nebraska, was held at City Hall Council Chambers in said City on the 12th day of April 2011, at 7:30 o’clock P.M. Present were: President of the Council: Darrell G. Bassett; Council Members: Stacey Bauer Kevin Block Mark Knudsen and Harold Peterson. Absent: None. City Manager: Harold Stewart; City Clerk: Jane M. Skinner; City Attorney: Michael McQuillan.
Notice of the meeting was given in advance thereof by publishing one time in the Keith County News and posting at the City Hall Administration Building as shown by the Certificate of Publication and Posting Notice attached to these Minutes. Notice of this meeting was simultaneously given to the President and to all members of the Council on April 8, 2011 and a copy of their Acknowledgement of Receipt of Notice and the Agenda is attached to these minutes. Availability of the agenda was communicated in the advance notice and in the Notice to the President and Council of this meeting. All proceedings hereafter shown were taken while the convened meeting was open to the attendance of the public. The President of the Council stated this meeting is being convened in accordance with the Open Meetings Act and acknowledged a copy of the Open Meetings Act being duly posted in the southeast Corner of Council Chambers.
Council President Bassett opened a public hearing regarding a public transportation service area expansion (Lake McConaughy and Lake Ogallala) at 7:32 P.M.
Travis Haggard, Economic Development Coordinator appeared before the council regarding a transit system between Lake Ogallala, Lake McConaughy and the City of Ogallala.
Council President Bassett opened a public hearing regarding the consideration of a project for which financial assistance is being sought from the Federal Transit Administration pursuant to the Federal Transit Act – Purchase of 14 passenger small bus with a wheelchair lift at 7:36 P.M.
Carol Maxson, Public Transportation Director, appeared before the council regarding the consideration of a project for which financial assistance is being sought from the Federal Transit Administration pursuant to the Federal Transit Act – Purchase of 14 passenger small bus with a wheelchair lift.
Council President Bassett recognized Jarrod Curtis for 10 years of service to the City of Ogallala in the parks department.
Council President Bassett recognized Deb Benner for her assistance in identifying carbon monoxide poisoning in passengers on the public transit bus.
Council President Bassett proclaimed April 10 – 16, 2011 as National Volunteer Week in Ogallala.
Council President Bassett proclaimed April 10-16, 2011 as a Week of the Young Child and the month of April 2011 as Youth and Family Appreciation Month.
Council President Bassett proclaimed April 10-16, 2011 as National Library Week.
Councilman Bauer moved to approve the minutes of the special meeting held March 22, 2011. Councilman Peterson seconded the motion. The following council members voted Yes: Darrell Bassett, Stacey Bauer, Kevin Block, and Harold Peterson. No: None. Abstain: Mark Knudsen. Absent: None. Motion declared carried.
Councilman Knudsen moved to approve the minutes of the regular meeting held March 22, 2011. Councilman Block seconded the motion. The following council members voted Yes: Darrell Bassett, Stacey Bauer, Kevin Block, Mark Knudsen and Harold Peterson. No: None. Absent: None. Motion declared carried.
City Clerk Skinner presented the financial report for March 2011.
Councilman Knudsen moved to approve application for a Gas Fitter License for Dell Simmerman. Councilman Peterson seconded the motion. The following council members voted Yes: Darrell Bassett, Stacey Bauer, Kevin Block, Mark Knudsen and Harold Peterson. No: None. Absent: None. Motion declared carried.
Councilman Knudsen moved to approve West Central Nebraska Development District administering the Energy Efficiency and Conservation Block Grant Program on behalf of the city. Councilman Block seconded the motion. The following council members voted Yes: Darrell Bassett, Stacey Bauer, Kevin Block, Mark Knudsen and Harold Peterson. No: None. Absent: None. Motion declared carried.
Council Peterson moved to approve the Goodall Recreation Center Expansion Contract with RBP Construction as presented by the engineer contingent upon the settlement of the security documents. Councilman Knudsen seconded the motion. The following council members voted Yes: Darrell Bassett, Stacey Bauer, Kevin Block, Mark Knudsen and Harold Peterson. No: None. Absent: None. Motion declared carried.
Travis Haggard, Economic Development Coordinator, addressed the council regarding recent economic development activities. Topics included were the Community Facts Book, Career Day, Entrepreneurship Class, and the Visitors Committee theme, “All trails lead to Ogallala”.
Police Chief Kling appeared before the council regarding the specifications, advertising and bid opening date for 2011 Police Package Vehicle.
Councilman Knudsen moved to approve the specifications, advertising and bid opening date for 2011 Police Package Vehicle as presented by staff. Councilman Peterson seconded the motion. The following council members voted Yes: Darrell Bassett, Stacey Bauer, Kevin Block, Mark Knudsen and Harold Peterson. No: None. Absent: None. Motion declared carried.
Councilman Block introduced a resolution to apply for State and Federal funding for the City of Ogallala Public Transportation System for Fiscal Year 2011-2012. Council President Bassett read the resolution by title and Councilman Knudsen seconded the motion. Upon roll call vote, the following Council Members voted “Yes”: Darrell Bassett, Stacey Bauer, Kevin Block, Mark Knudsen, and Harold Peterson. The following council Members voted “No”: None. Absent: None. Motion declared carried and Resolution No. 1318 adopted, a copy of said Resolution being attached hereto and by this express reference, incorporated herein and made a part hereof.
Council President Bassett closed a public hearing regarding a public transportation service area expansion (Lake McConaughy and Lake Ogallala) at 8:21 P.M.
Councilman Knudsen moved to approve establishing a transit system connecting Lake McConaughy, Lake Ogallala, and the City of Ogallala for the 2011 summer. Councilman Block seconded the motion. The following council members voted Yes: Darrell Bassett, Stacey Bauer, Kevin Block, Mark Knudsen and Harold Peterson. No: None. Absent: None. Motion declared carried.
Council President Bassett closed a public hearing regarding the consideration of a project for which financial assistance is being sought from the Federal Transit Administration pursuant to the Federal Transit Act – Purchase of 14 passenger small bus with a wheelchair lift at 8:23 P.M.
Councilman Peterson moved to approve the purchase of a 14 passenger small bus with a wheelchair lift. Councilman Knudsen seconded the motion. The following council members voted Yes: Darrell Bassett, Stacey Bauer, Kevin Block, Mark Knudsen and Harold Peterson. No: None. Absent: None. Motion declared carried.
Councilman Knudsen moved to approve staff to use services from West Central Nebraska Development District regarding the RSVP paperwork. Councilman Peterson seconded the motion. The following council members voted Yes: Darrell Bassett, Stacey Bauer, Kevin Block, Mark Knudsen and Harold Peterson. No: None. Absent: None. Motion declared carried.
John Trecek of Ameritas Investment Corporation addressed the council regarding the creation of water and sewer extension or connection districts.
Councilman Knudsen introduced Ordinance 1278. Council President Bassett read Ordinance 1278 by title, An ordinance creating Sanitary Sewer Connection District No. 2011-1 of the City of Ogallala, Nebraska; establishing the outer boundaries of the District; designating the size, location and termination points of the water mains to be constructed; providing for a connection fee and ordering the publication of the ordinance in pamphlet form. Council President Bassett announced that Ordinance 1278 was read for the first time.
Councilman Knudsen introduced Ordinance 1279. Council President Bassett read Ordinance 1279 by title, An ordinance creating Water Connection District No. 2011-1 of the City of Ogallala, Nebraska; establishing the outer boundaries of the District; designating the size, location and termination points of the water mains to be constructed; providing for a connection fee and ordering the publication of the ordinance in pamphlet form. Council President Bassett announced that Ordinance 1279 was read for the first time.
Councilman Knudsen introduced a resolution declaring the City of Ogallala’s intent to incur debt which may include reimbursement of expenditures made by the City for the construction of water and sewer improvements in Sanitary Sewer Connection District No. 2011-1 and Water Connection District No. 2011-1 in the City. Council President Bassett read the resolution by title and Councilman Knudsen seconded the motion. Upon roll call vote, the following Council Members voted “Yes”: Darrell Bassett, Stacey Bauer, Kevin Block, Mark Knudsen, and Harold Peterson. The following council Members voted “No”: None. Absent: None. Motion declared carried and Resolution No. 1319 adopted, a copy of said Resolution being attached hereto and by this express reference, incorporated herein and made a part hereof.
The council discussed the resignation of City Manager Harold Stewart. Councilman Knudsen moved to appoint Darrell Bassett, Kevin Block, Eric Duhachek, Paul Foy, Greg Hilt, Tom Kalkowski, Gail Knott, Doug Teaford, and Curt VanLaningham to the City Manager Search Committee. Councilman Peterson seconded the motion. The following council members voted Yes: Darrell Bassett, Stacey Bauer, Kevin Block, Mark Knudsen and Harold Peterson. No: None. Absent: None. Motion declared carried.
The City Council will meet for a special meeting on April 26, 2011 to discuss the hiring process for the next City Manager and discuss priorities and qualities desired in the next city manager.
There being no further business to come before the council, Councilman Peterson moved to adjourn. Councilman Block seconded the motion. The following council members voted Yes: Darrell Bassett, Stacey Bauer, Kevin Block, Mark Knudsen and Harold Peterson. No: None. Absent: None. Motion declared carried and the meeting adjourned at 9:03 P.M.

Skinner, the undersigned, City Clerk for the City of Ogallala, Nebraska, hereby certify that all of the subjects included in the attached proceedings were contained in the Agenda for the meeting of April 12, 2011 kept continuously current and available for public inspection at the office of the City Clerk; that such subjects were contained in said Agenda for at least twenty-four hours prior to said meeting; that at least one copy of all reproducible material discussed at the meeting was available at the meeting for examination and copying by members of the public; that the Minutes of the President and Council of the City of Ogallala, Nebraska, were in written form and available for public inspection within ten working days and prior to the next convened meeting of said body; that all news media requesting notification concerning meeting of said body were provided advance notification of the time and place of said meeting and the subjects to be discussed at said meeting.
