REGULAR MEETING OF THE CITY COUNCIL
JUNE 14, 2011
A Regular Meeting of the City Council of the City of Ogallala, Nebraska, was held at City Hall Council Chambers in said City on the 14th day of June 2011, at 7:30 o’clock P.M. Present were: Vice-President of the Council: Mark Knudsen; Council Members: Stacey Bauer, Kevin Block, and Harold Peterson. Absent: Darrell G. Bassett. Interim City Manager: Jane M. Skinner; Deputy City Clerk: Naomi Thiesen; City Attorney: Michael McQuillan.
Notice of the meeting was given in advance thereof by publishing one time in the Keith County News and posting at the City Hall Administration Building as shown by the Certificate of Publication and Posting Notice attached to these Minutes. Notice of this meeting was simultaneously given to the President and to all members of the Council on June 10, 2011 and a copy of their Acknowledgement of Receipt of Notice and the Agenda is attached to these minutes. Availability of the agenda was communicated in the advance notice and in the Notice to the President and Council of this meeting. All proceedings hereafter shown were taken while the convened meeting was open to the attendance of the public. The President of the Council stated this meeting is being convened in accordance with the Open Meetings Act and acknowledged a copy of the Open Meetings Act being duly posted in the southeast Corner of Council Chambers.
Councilman Block moved to excuse Council President Bassett from the June 14, 2011 City Council Meeting. Councilman Peterson seconded the motion. The following council members voted Yes: Stacey Bauer, Kevin Block, Mark Knudsen and Harold Peterson. No: None. Absent: Darrell Bassett. Motion declared carried.
Councilman Block moved to approve the consent agenda. Councilman Bauer seconded the motion. The following council members voted Yes: Stacey Bauer, Kevin Block, Mark Knudsen and Harold Peterson. No: None. Absent: Darrell Bassett. Motion declared carried and the consent agenda was approved as follows:
A. Minutes of the Regular Meeting held May 24, 2011.
B. O.V.F.D. - Probationary membership of Cole Peters.
Council Vice-President Knudsen recognized Ken Knoepfel who serves as the LUCA (Local Update of Census Addresses) Program Administrator for the U.S. Census Bureau for his participation on behalf of the city of Ogallala in the 2010 Census.
Council Vice-President Knudsen recognized John Sauer, Water Superintendent, for his ten years of service to the city of Ogallala.
City Clerk Skinner presented the financial report for May 2011.
Brenda Ketcham addressed the council regarding the Special Designated Liquor Licenses in conjunction with the Taste of Keith County Event to be held June 30, July 28, August 25 and September 25, 2011.
Councilman Peterson moved to approve the Special Designated Liquor Licenses for White Bison LLC dba 5 Trails Winery events to be held June 30, July 28, August 25 and September 22, 2011 and 17 Ranch Winery LTD event to be held June 30, July 28, August 25 and September 22, 2011 during the Ogallala/Keith County Chamber of Commerce Taste of Keith County Event. Councilman Block seconded the motion. The following council members voted Yes: Stacey Bauer, Kevin Block, Mark Knudsen and Harold Peterson. No: None. Absent: Darrell Bassett. Motion declared carried.
Councilman Bauer moved to reject all bids for the Nebraska Energy Retrofit Project EECDB 09/10 E-095. Councilman Block seconded the motion. The following council members voted Yes: Stacey Bauer, Kevin Block, Mark Knudsen and Harold Peterson. No: None. Absent: Darrell Bassett. Motion declared carried.
Councilman Bauer moved to deny Ron Schmidt’s request for an exemption to the Permitted Business Activities as defined in Section 10 of the Ogallala Airport Minimum Standards to allow for a motor vehicle service and repair center in the hangar/office space located at 174 Airport Road. Councilman Block seconded the motion. The following council members voted Yes: Stacey Bauer, Kevin Block, Mark Knudsen and Harold Peterson. No: None. Absent: Darrell Bassett. Motion declared carried.
Brenda Ketchum, Ogallala/Keith County Chamber of Commerce and Cory Scott of RDG Schutte Wilscam Birge, Inc. addressed the council regarding the Downtown Revitalization Planning project.
Councilman Bauer moved to approve the implementation of the Community Development Block Grant Downtown Revitalization Planning project (10-DTR-008) and authorize the downtown revitalization steering committee to complete application to the Nebraska Department of Economic Development for phase II funding. Councilman Block seconded the motion. The following council members voted Yes: Stacey Bauer, Kevin Block, Mark Knudsen and Harold Peterson. No: None. Absent: Darrell Bassett. Motion declared carried.
Councilman Peterson moved to approve the agreement for Western Diamonds Sports Complex concession service with Elsa Flores. Councilman Bauer seconded the motion. The following council members voted Yes: Stacey Bauer, Kevin Block, Mark Knudsen and Harold Peterson. No: None. Absent: Darrell Bassett. Motion declared carried.
Brenda Ketcham representing the Rendezvous Committee appeared before the council to request a fee waiver for picnic tables for use at the Indian Summer Rendezvous activities.
Councilman Bauer moved to approve a fee waiver for picnic table use for the Indian Summer Rendezvous activities for the 2011 year. Councilman Peterson seconded the motion. The following council members voted Yes: Stacey Bauer, Kevin Block, Mark Knudsen and Harold Peterson. No: None. Absent: Darrell Bassett. Motion declared carried.
Council Vice President Knudsen announced Ordinance 1281 was introduced and read for the first time on May 24, 2011. Council Vice President Knudsen read Ordinance 1281 by title, an ordinance amending section 37-308 street names and numbers of the municipal code of the City of Ogallala, Nebraska. Council Vice President Knudsen announced that Ordinance 1281 was read for the second time.
Council Vice President Knudsen announced Ordinance 1282 was introduced and read for the first time on May 24, 2011. Council Vice President Knudsen read Ordinance 1282 by title, an ordinance amending section 41-901 all-terrain vehicles and utility-type vehicles, and the penalty section is renumbered to 41-1001 of the municipal code of the City of Ogallala, Nebraska. Council Vice President Knudsen announced that Ordinance 1281 was read for the second time.
John Detuerk appeared before the council in opposition to Ordinance 1282. Trevor Foster appeared before the council in support of Ordinance 1282.
Brent Burklund of T.C. Engineering addressed the council regarding the plans, specification and bid opening dates for Sewer Connection District 2011-1 and Water Connection District 2011-1.
Councilman Peterson moved to approve the plans, specification and bid opening dates for Sewer Connection District 2011-1 and Water Connection District 2011-1. Councilman Block seconded the motion. The following council members voted Yes: Stacey Bauer, Kevin Block, Mark Knudsen and Harold Peterson. No: None. Absent: Darrell Bassett. Motion declared carried.
The proposed schedule for the City Manager Interview process scheduled for June 29 – July 1, 2011 was presented to the council.
There being no further business to come before the council, Councilman Peterson moved to adjourn. Councilman Bauer seconded the motion. The following council members voted Yes: Stacey Bauer, Kevin Block, Mark Knudsen and Harold Peterson. No: None. Absent: Darrell Bassett. Motion declared carried and the meeting adjourned at 8:54 P.M.

I, Jane M. Skinner, the undersigned, City Clerk for the City of Ogallala, Nebraska, hereby certify that all of the subjects included in the attached proceedings were contained in the Agenda for the meeting of June 14, 2011 kept continuously current and available for public inspection at the office of the City Clerk; that such subjects were contained in said Agenda for at least twenty-four hours prior to said meeting; that at least one copy of all reproducible material discussed at the meeting was available at the meeting for examination and copying by members of the public; that the Minutes of the President and Council of the City of Ogallala, Nebraska, were in written form and available for public inspection within ten working days and prior to the next convened meeting of said body; that all news media requesting notification concerning meeting of said body were provided advance notification of the time and place of said meeting and the subjects to be discussed at said meeting.
