Meeting
April 20, 2004
A meeting of the Ogallala Board of Health was called to order at 7:30 P.M. by Chairman, Paul Foy in the City of Ogallala Administration Building, 411 East Second Street, Ogallala, Nebraska. Members present: Dr. Paul Foy, Mary Lou Heelan, Dr. Kurt Johnson and Joe Humphrey. Absent: Glenn Silvius.
Notice of the meeting was given in advance by publication in the Keith County News, the designated method of giving notice. Notice of the meeting was delivered to members of the Board of Health by hand delivery of an Ogallala Police Officer.
Mary Lou Heelan moved to approve the minutes of the March 16, 2004 Board of Health Meeting. Dr. Kurt Johnson seconded the motion. Voting Yes: Heelan, Johnson, Foy and Humphrey. Voting No: None.
Public Forum: Dr. Foy opened the public forum and invited any individual wishing to speak to the board to come to the podium. Dr. Foy advised that the Public Forum would remain open for the duration of the public meeting.
Bullock Motors, 801 West 1st Street. Humphrey informed the Board that he had inspected the property at 801 West 1st and that the property is in compliance with Municipal Code. Humphrey also advised the Board that he had discussed the property with the Nebraska Motor Vehicle Industry Licensing Board Investigator. The license for this property had been revoked in December 2003 for not maintaining a place of business and is not currently licensed to sell motor vehicles.
Heelan moved to service notice on Noel Bullock giving him thirty (30) days to have a dealership license application, for 801 West 1st Street, on file with the Nebraska Motor Vehicle Industry Licensing Board or to remove all the vehicles from the property. Johnson seconded the motion. Voting Yes: Foy, Heelan, Johnson and Humphrey. Voting No: None. Motion Carried.
Pat Darnell spoke to the Board concerning the property just east of 910 West 6th Street. Mrs. Darnell informed the Board that she owned the rental property of 910 West 6th Street and felt that the use of the adjacent property for storage of boats, duck blinds and campers was unsightly and a detriment to her leasing her property. She presented five photographs of the two properties.
John Sauer then spoke to the Board. Mr. Sauer is the owner of the property in question. He informed the board that he vehicles being stored on the property all belong to him, that he is not using the property in a commercial manner. He is attempting to make improvements to the property by adding a driveway however he has to wait until a contractor with a city right-of-way permit can do the concrete work for the driveway.
After some discussion Mrs. Darnell and Mr. Sauer agreed to work together to formulate a plan on the placement of the vehicles, on the property, so that some of the vehicles could not be seen from Mrs. Darnell’s property.
Humphrey informed the Board that the next scheduled meeting, Tuesday, May 18, 2004.
No further business to come before the Board, Johnson moved to adjourn. Heelan seconded the motion.
Voting Yes: Foy, Heelan, Silvius, Johnson and Humphrey. Voting No: None.
Motion Carried.
