Meeting
November 16, 2004
A meeting of the Ogallala Board of Health was called to order at 7:30 P.M. by Chairman Paul Foy in the City of Ogallala Administration Building, 411 East Second Street, Ogallala, Nebraska. Members present: Dr. Paul Foy, Mary Lou Heelan, Glenn Silvius and Joe Humphrey. Absent: Dr. Kurt Johnson.
Notice of the meeting was given in advance by publication in the Keith County News, the designated method of giving notice. Notice of the meeting was delivered to members of the Board of Health by hand delivery of an Ogallala Police Officer.
Mary Lou Heelan moved to approve the minutes of the October 19, 2004 Board of Health Meeting. Humphrey seconded the motion. Voting Yes: Foy, Heelan, and Humphrey. Voting No: None. Abstain: Silvius. Motion Carried
Public Forum: Dr. Foy opened the public forum and invited any individual wishing to speak to the board to come to the podium. Dr. Foy advised that the Public Forum would remain open for the duration of the public meeting.
Humphrey informed the Board that the City had received several complaints about the condition of the apartment building located at 400 East 10th Street and owned by David Fitzpatrick. City Zoning and Building Inspector Ken Knoepfel and he inspected the property on November 1, 2004. Humphrey informed the board that there was an accumulation of bicycle parts, trash, litter and other materials located on the property. The interior of the upper apartments contained discarded furniture and other household items as well as trash and refuse. Apartment #7 was being used as a storage facility for trash and junk discarded by prior tenants.
David Fitzpatrick spoke to the board, informing them that he has not had much luck in obtaining good renters and the renters that he has had in the past have left him with back rent due and leaving their trash and worthless belongings behind. Mr. Fitzpatrick felt that he could have the property in compliance with municipal code within 30 days.
Joe Humphrey moved to serve notice upon Mr. David Fitzpatrick as property owner of 400 East 10th Street, Ogallala, Nebraska to bring this property into compliance with City of Ogallala Municipal Code §94.018 by 5:00 P.M. Mountain Standard Time Thursday, December 16, 2004 Glenn Silvius seconded the motion. Voting Yes: Foy, Heelan, Humphrey and Silvius. Voting No: None. Motion carried.
No further business to come before the Board, Heelan moved to adjourn. Silvius seconded the motion.
