Minutes

A meeting of the Ogallala Board of Health was called to order at 7:33 P.M. by Dr. Paul Foy in the City of Ogallala Administration Building, 411 East Second Street, Ogallala, Nebraska. Members present: Dr. Paul Foy, Glen Silvius, and Acting Secretary Rod Kolsrud. Also present was Ogallala Police Department Code Enforcement Officer Eric Troxel. Absent were Mary Lou Heelan and Dr. Kurt Johnson.

Notice of the meeting was given in advance by publication in the Keith County News, the designated method of giving notice. Notice of the meeting was delivered to members of the Board of Health by hand delivery of an Ogallala Police Officer.

Glen Silvius moved to approve the minutes of the July 19, 2005 Board of Health meeting and the motion was seconded by Kolsrud. Voting Yes: Silvius and Kolsrud. Voting No: None. Abstain: Dr. Paul Foy. Absent: Mary Lou Heelan and Dr. Kurt Johnson. Motion carried.

Public Forum: Dr. Foy opened the public forum and invited any individual wishing to speak to the board to come to the podium. Dr. Foy advised that the Public Forum would remain open for the duration of the public meeting.

Discussion was held regarding a construction storage lot in the area of North Spruce and West 32^nd Street to determine whether the property was in violation of city codes. Kolsrud provided a copy of the applicable city ordinances for review. It was the consensus of the board members present that the owners of the construction storage lot be contacted and informed of the violations to be corrected.

Discussion was held pertaining to properties of concern: Officer Troxel presented Code Enforcement Activity report for the month of July with special attention to properties located in the Northwest Trailer, the 100 block of East I, and the 200 block of East O. Other properties with concerns about weeds and trash accumulation were also discussed.

Discussion was held regarding an abandoned building and property located at 201 South Spruce Street in Ogallala Nebraska, with concerns about the building being unsecured, tall weeds, and accumulated junk vehicles and piles of scrap metal. Photographs of the property were provided to the board members present.

Dr. Foy moved to serve notice on the property owner, Tim Chandler, to secure the building from entry and to bring the property located at 201 South Spruce Street, Ogallala, Nebraska, into compliance with the City of Ogallala Municipal Code §94.018 by 7:30 P.M. Mountain Daylight Time on Tuesday, September 20, 2005, and that failure to bring the property into compliance will result in the Ogallala Board of Health to declare this property a Public Nuisance. Glen Silvius seconded the motion. Voting Yes: Dr. Foy, Silvius, Kolsrud. Voting No: None. Absent: Mary Lou Heelan and Dr. Kurt Johnson. Motion carried.

No further business to come before the Board, Glen Silvius made a motion to adjourn, seconded by Kolsrud. Voting Yes: Dr. Foy, Silvius, and Kolsrud. Voting No: None. Absent: Mary Lou Heelan and Dr. Kurt Johnson. Motion Carried.
