Minutes

 

A meeting of the Ogallala Board of Health was called to order at 7:31 P.M. by Chairman Dr. Paul Foy in the City of Ogallala Administration Building, 411 East Second Street, Ogallala, Nebraska.  Members present:  Dr. Paul Foy, Glen Silvius, Dr. Kurt Johnson, Mary Lou Heelan, and Acting Secretary Rod Kolsrud.  Also present: Ogallala Police Department Code Enforcement Officer Eric Troxel.

 

Notice of the meeting was given in advance by publication in the Keith County News, the designated method of giving notice. Notice of the meeting was delivered to members of the Board of Health by hand delivery of an Ogallala Police Officer.

 

A motion was made by Glen Silvius to approve the minutes of the August 16, 2005 Board of Health meeting; seconded by Dr. Foy.  Voting Yes:  Silvius, Dr. Foy, and Kolsrud.  Voting No:  None.   Abstain:  Mary Lou Heelan and Dr. Kurt Johnson.  Motion carried. 

 

Public Forum: Dr. Foy opened the public forum and invited any individual wishing to speak to the board to come to the podium.  Dr. Foy advised that the Public Forum would remain open for the duration of the public meeting. 

 

Russ and Renee Peterson, owners of RBP Construction located at 3106 Spruce Acres, addressed the Board to inquired as to what specific violations were on their property.  Silvius made statement that there was some equipment stored on the property and along the parking lot that was unsightly to passing motorists, and suggested erecting a fence to conceal the equipment from public view.  Peterson remarked that they try to keep ahead of the weed problems on the property as best they can and it was the consensus of the board that they have been complying in a very timely manner with keeping the area mowed.  There was some scrap iron outside the fence, but Peterson advised that some subjects had been contacted to haul any scrap material to the recyclers and it was more practical to leave the scrap outside the fence as the subjects would normally load the scrap materials after business hours when the gates would be shut and secured.   Dr. Foy and Mary Lou Heelan indicated that due to the nature of the business, they had no problems with the appearance of the property.

 

Discussion was held pertaining to the Tim Chandler property located at 201 South Spruce Street in Ogallala.  No activity had been observed to indicate the property owner had taken any action to clean up the property in order to comply with City Ordinance.  A notice was sent to Mr. Chandler via certified mail regarding the violations and it has not been claimed by Mr. Chandler.  Mention was made by Mr. Chandler prior to the notice being sent about a question regarding actual ownership of the property.  Dr. Foy made a motion to authorize a title search to be done on the property so that the owners could be accurately determined.  Dr. Johnson seconded the motion.   Voting Yes:  Dr. Foy, Dr. Johnson, Mary Lou Heelan, Glen Silvius, and Rod Kolsrud.  Voting No:  None.  Motion carried.  Dr. Foy was going to make arrangements to have the title search conducted.     

 

Discussion was held regarding the property located in the 800 block of East 1st, the old Midwest Motel, regarding the security of the buildings and possible access by rodents and other vermin, along with the appearance due to weeds.  It was the consensus of the Board to further inspect the property for further violations. 

 

Discussion was held pertaining to properties of concern:  Officer Troxel presented Code Enforcement activity for the month of August. 

 

Discussion was held regarding the unwanted birds roosting in trees, and different options suggested by USDA personnel to address the issue. 

 

No further business to come before the Board,   Dr. Johnson made a motion to adjourn, seconded by Kolsrud.  Voting Yes: Dr. Foy, Dr. Johnson, Glen Silvius, Mary Lou Heelan, and Rod Kolsrud.  Voting No: None.  Motion Carried.
